GM recalls 100,000 vehicles over crash-safety concerns.| Avalanche | CTS | Escalade | Silverado

NATIONAL - The AP recently reported General Motors is recalling nearly 100,000 vehicles to address issues related to crash safety. Postings with the National Highway Traffic Safety Administration said GM was recalling nearly 96,000 2005 to 2007 models of the Cadillac CTS for airbag defects.

GM said "repeated flexing of the sensing mat in the passenger seat can cause the mat to bend or fold so much that the sensor may not detect a passenger is sitting in the seat. Therefore, the sensor wouldn't activate the airbag in the event of a crash."

The automaker also recalled about 1,300 2011 models of the Chevrolet Avalanche 1500, GMC Sierra 1500, Cadillac Escalade, and Silverado 1500 for rear axle defects that can cause unexpected crashes.

DISNEY BUS ACCIDENT - Disney Transportation

WALT DISNEY WORLD - A Disney transportation bus filled with passengers hit and killed a pedstrian guest Sunday in the Parking lot of the Port Orleans Resort.

The Florida Highway Patrol spokesperson said, "the crash is still under investigation and the bus driver will likely not be charged.

The injured man was taken to Orlando Medical Center where he later died.

Toyota agrees to $32 million in civil penalties • NHSTA •

NATIONAL - Toyota Motor Corp. has agreed to pay an additional $32.425 million in civil penalties as the result of two separate federal investigations into the automaker's handling of auto recalls..

Toyota will pay the maximum fines allowable under the law - $16.375 million in one case and $16.050 million in the other - in response to the Transportation Department's assertion that it failed to comply with the requirements of the National Traffic and Motor Vehicle Safety Act for reporting safety defects to the National Highway Traffic Safety Administration (NHTSA).

The second investigation resulted in a $16.050 million fine. In that case, NHTSA investigated whether Toyota properly notified the agency of a safety defect in several Toyota models that could result in the loss of steering control. In 2004, Toyota conducted a recall in Japan for Hilux trucks with steering relay rods prone to fatigue cracking and breaking, causing the vehicle to lose steering control. At that time, Toyota informed NHTSA that the safety defect was isolated to vehicles in Japan and that the company had not received similar field information within the United States. In 2005, however, Toyota informed NHTSA that the steering relay rod defect was present in several models sold in the U.S. and conducted a recall for nearly one million vehicles. Then, in May 2010, NHTSA was alerted to additional information, including complaints from U.S. consumers, that Toyota had not disclosed when Toyota initially notified NHTSA that a U.S. recall was unnecessary.

PRODUCT RECALL | Cochlear implant device recalled due to malfunctions

NATIONAL - According to MedPage Today, "Makers of a cochlear implant device have issued a voluntary recall of the device due to malfunctions that may cause severe pain and shocking sensations within a few days of activation." According to the manufacturer, "Advanced Bionics, the HiRes 90K cochlear implant had to be removed from two patients after they experienced pain, overly loud sounds, and/or shocks eight to 10 days after the device was implanted." Advanced Bionics said "that the risk of adverse events is remote and that it is working with the FDA to make changes in the product."

In a recent article in USA Today, "If a 747 jetliner crashed every day, killing all 500 people aboard, there would be a national uproar over aviation safety and an all-out mobilization to fix the problem."

USA Today goes on to recommend the expanded use of medical checklists, greater transparency to allow patients to "evaluate their local hospitals," and use of financial incentives that would prevent hospitals from profiting from failure.

Florida court absolves some builders of Chinese drywall liability

According to The Wall Street Journal (11/12, Wotapka, Whelan) reports that a circuit court judge in Palm Beach County, Florida, has relieved some homebuilders of liability for installing tainted Chinese drywall, which is blamed for torpedoing home values and damaging residents' health.

The ruling is expected to serve as a precedent in other jurisdictions, and was based on the fact that the homebuilders did not manufacture the defective product. Florida's Centerline Homes was the defendant in the relevant case.

According to the Dow Jones Newswires (11/10, Loftus) reported that Johnson & Johnson disclosed Wednesday that it is in talks with the government to settle an investigation into whether the company improperly marketed the antipsychotic Risperdal.

DUNEDIN GOLF CART ACCIDENT | Serious and fatal injuries can occur | City approved golf carts for street use

DUNEDIN - The city of Dunedin unanimously approved allowing golf carts on city roads at a City Hall meeting.  According to BayNews 9, a city ordinance allowed people to drive golf carts within a one mile radius of the Dunedin Golf Club. Now leaders are expanding the ordinance to allow the golf carts throughout Dunedin.

SAFETY IS A BIG CONCERN.  Golf carts are designed for use on a golf course and lack the necessary safety equipment for regular daily road use.  This approval is by the city is a recipe for disaster.  

City leaders have not decided exactly which roads they'd allow the golf carts on. The city attorney is now looking into just the south side at this time and not the whole city.  The city council will continue to work in phases to get the whole city golf cart-approved.

According to information from the National Highway Traffic Safety Administration (NHTSA), in 2009, 995 of 5,474 traffic accident fatalities involved reports of a cell phone as a distraction. DePuy ASR Hip Replacement | LITIGATION | Recall HIP IMPLANT

NATIONAL - The DePuy ASR Hip Replacement litigation is rapidly growing. There are more than a dozen DePuy ASR Hip Replacement class actions.  In addition, many individual suits have been filed in federal and state courts around the country. It has been estimated that about 93,000 people around the world received one of the recalled implants.

Johnson & Johnson’s DePuy Orthopaedics unit announced the recall of the DePuy ASR Hip Implant system in August, after data from the National Joint Registry of England and Wales showed that 1 out of every 8 patients (12%-13%) who had received the recalled devices had to undergo revision surgery within five years of receiving it.

The recall involved the ASR XL Acetabular System, a hip socket used in traditional hip replacement, and the ASR Hip Resurfacing System, a partial hip replacement that involves placing a metal cap on the ball of the femur. Only the ASR XL Acetabular System was approved for use in the US. DePuy ASR Hip Replacement lawsuits allege that the metal-on-metal hip replacement device was defectively designed, and that DePuy knew its hip replacements were failing at a higher than expected rate, but didn’t alert consumers or orthopedic surgeons.

TRAMPOLINE RECALL ♦ TRAMPOLINE INJURIES

NATIONAL - Bravo Sports just recalled about 160,000 Bravo Sports Trampolines due to fall hazard, the US Consumer Product Safety Commission (CPSC) just announced. The CPSC advising consumers to stop using the recalled Trampolines immediately and notes that it’s illegal to resell or to attempt to resell a recalled consumer product.

Incorrectly assembled trampolines can allow the top rails and legs to bend or break during normal use, resulting in partial collapse of the trampoline. This poses a fall hazard to consumers. To date, Bravo has received 247 reports of top rails bending or breaking during normal use. Four (4) injuries have been reported due to the bending and breaking of trampolines

WARNING ON AVANDIA ♦ INCREASED RISK OF HEART ATTACK ♦

NATIONAL - In a recent article in the New England Journal of Medicine announced that, finally, the FDA has stepped forward and decided on regulatory action for Avandia, a diabetes drug that last year claimed 1,354 lives as a result of cardiac-associated problems.

The FDA is restricting access to Avandia by requiring GSK to submit a Risk Evaluation and Mitigation Strategy, or REMS.

Under the ruling, the drug will be available to patients not already taking it only if they are unable to achieve glycemic control using other medications and, in consultation with their health care professional, decide not to take a different drug for medical reasons.

Current users of Avandia will be able to continue using the medication if they appear to be benefiting from it and they acknowledge that they understand these risks. Doctors will have to attest to and document their patients’ eligibility; patients will have to review statements describing the cardiovascular safety concerns.

Mercedes recalls for power steering problems that could lead to accident

NATIONAL - Mercedes-Benz has recalled 85,000 of its 2010 and 2011 models because a steering problem could make the vehicles difficult to control. 

The models are the 2010 C-Class and the 2010-11 E-Class, the automaker told the National Highway Traffic Safety Administration in a recent report. 

Mercedes said a connection fitting on the high-pressure power steering line might not be tight enough, allowing power-steering fluid to leak.  As a result, “Owners may not have sufficient control of the vehicle under circumstances such as parking where maximum power steering is required.” The company added that the problem “could lead to a vehicle crash.”

J & J | Motrin | McNeil | Defective Drug

NATIONAL - According to USA Today (10/5) editorializes, "Last year, when J&J faced what should have been a relatively minor problem, executives forgot to read their own textbook." J&J "discovered in late 2008 that some Motrin tablets, made by its McNeil division, were not dissolving properly, possibly affecting their potency. So did executives publicly announce the problem and recall the defective product?"

USA Today continues, "Hardly. Instead, J&J hired a contractor that quietly dispatched workers to retailers to buy up thousands of the Motrin vials. ... In other words, the goal was to hide the problem."

Now J&J "could use some extra-strength Tylenol for a public relations migraine it richly deserves."

ALLSTATE v. Toyota | SUBRO action | Sudden acceleration claims

NATIONAL - According to the Los Angeles Times (10/5, Bensinger, Vartabedian) reports, "Allstate Corp. has sued Toyota Motor Corp. over sudden-acceleration-related claims it has paid, alleging that the accidents were caused by vehicle defects. The suit, filed Friday in Los Angeles County Superior Court, seeks $3 million in compensation for about 270 claims that the insurance giant has paid out since January 2007."

Allstate spokeswoman Christina Loznicka "said the suit was 'a last resort' taken after negotiations on the claims with Toyota, a practice called subrogation, failed out of court."

TOY RECALLS | Fisher-Price recalls millions of toys over safety hazards

NATIONAL - According to the Houston Chronicle (10/1, Lee) reports, "Local retailers pulled Fisher-Price tricycles, high chairs and toys from their shelves Thursday after the company announced a recall of more than 10 million products because of safety hazards. .. The recall is the largest for toys since Congress gave" the US Consumer Product Safety Commission "more regulatory power two years ago." The agency "in cooperation with the company, issued a voluntary recall of 7 million Fisher-Price Trikes and Tough Trikes. It also recalled about 1 million Healthy Care, Easy Clean and Close to Me High Chairs."

In addition, the AP (10/1) reports, "CPSC Chairman Inez Tenenbaum said manufacturers need to do more to build safety into their products before they reach store shelves. But she also offered praise for Fisher-Price for 'taking the right steps by agreeing to these recalls and offering consumers free repairs or replacement.'"

NATIONAL - Recently The Hartford Financial Services Group agreed to a $72.5 million class-action settlement.  This settlement will end a dispute over structured settlements in personal injury and workers compensation cases. This settlement will cover 21,600 people nationwide.

The lawsuit alleged that The Hartford's property and casualty companies purchased annuities from its life insurance subsidiary and then deducted as much as fifteen (15) percent in undisclosed costs from the promised value of the annuity.

FEMUR FRACTURE | Panel Recommends Thigh Fracture Warning for Bone Drugs | Actonel, Boniva, and Fosamax

NATIONAL - The American Society of Bone and Mineral Research Femoral Fracture Task Force is recommending that US health regulators rewrite the warning labels for a popular class of osteoporosis drugs called bisphosphonates because of their possible association with atypical femur fractures. Bisphosphonates include drugs sold under the brand names Actonel, Boniva, and Fosamax. 

The task force recommendation was prompted by its finding that the bone drugs might be linked to the rare, but serious, type of thigh bone fracture. The study was released today, and is slated to be published in the Journal of Bone and Mineral Research.

PINELLAS COUNTY - Crossing the streets in Pinellas County can be deadly.  In recent years, Pinellas was the only county in West Central Florida that had an increase in pedestrian fatalities. According to Florida Department of Transportation (FDOT) statistics, 30 people died. 

This year FDOT officials are optimistic.  "Our pedestrian fatalities, even all of our traffic fatalities are down in percentage right now," said Kris Carson, a spokesman with Florida Department of Transportation. 

Pinellas County is on track to have the lowest number of pedestrian deaths since 2004. 

One reason the numbers could be lower is the new initiatives like the pedestrian flags that are now up along several busy roads. Pedestrians along Gulf Boulevard are actually using the pedestrian flags when they cross the road.  However, some people who walk around Gulf Boulevard everyday are still worried pedestrian accidents.

NATIONAL - The National Transportation Safety Administration (NTSB) has issued a press release calling for 21 states, including Florida, to toughen their child restraint laws. 

The NTSB said child passenger safety laws in 21 states and two U.S. territories do not meet their safety recommendations. 

The press release said Florida has the most lenient child passenger safety laws in the nation, only requiring child safety seats for children 3 or younger. 

Since 1996, the NTSB has called for state child restraint laws to cover all children up to 8 years old.

NATIONWIDE - Highway deaths fell to 33,808 in the U.S. for the year 2009, the lowest number since 1950. The decline in traffic fatalities occurred even while estimated vehicle miles traveled in 2009 increased by 0.2 percent over 2008 levels, according to the Department of Transportation.

In addition, 2009 saw the lowest fatality and injury rates ever recorded: 1.13 deaths per 100 million vehicle miles traveled in 2009, compared to 1.26 deaths for 2008. 

Fatalities declined in all categories of vehicles including motorcycles, which saw fatalities fall by 850 from 2008, breaking an 11-year cycle of annual increases. 

In addition, the number of people injured in motor vehicle crashes in 2009 declined for a tenth straight year in a row, falling an estimated 5.5 percent from 2008, according to the National Highway Traffic Safety Administration. 

Alcohol impaired driving fatalities declined by 7.4 percent in 2009 – 10,839 compared to 11,711 reported in 2008. Overall, 33 states and Puerto Rico experienced a decline in the number of alcohol-impaired driving fatalities in 2009 compared to 2008. 

"Today's numbers reflect the tangible benefits of record seat belt use and strong anti-drunk driving enforcement campaigns," said NHTSA Administrator David Strickland. "But we are still losing more than 30,000 lives a year on our highways, and about a third of these involve drunk driving."

UNREASONABLE HOSPTIAL BILL? | Need help | Florida Injury Attorney

STATEWIDE - According to Forbes magazine, this week released its first-ever survey of America's most profitable hospitals, revealing that 24 hospitals with more than 200 beds make 25 cents or more for every dollar of patient revenue they take in.

The report is being widely disseminated by the health insurance industry, which is pushing back against claims that health insurance profits -- rather than rising medical costs -- are to blame for rising premiums.  In the survey, "Forbes points out that hospital charges account for about a third of healthcare spending, or $718 billion -- more than any other single category."

In an earlier report, Bloomberg cited Princeton economist Alain Enthoven saying that hospital expenses rose "largely because of the pricing power of local hospital systems," and calling for "effective antitrust enforcement."

MORE GOLF CART ACCIDENTS? | Golf Cart rules change statewide | ELLENTON LAKEWOOD RANCH

MANATEE COUNTY - You may notice more golf carts around the Bay area. On September 1, 2010 a state law that prohibits residents from riding their golf carts on sidewalks will change. A clause in House Bill 971 has been approved, allowing counties to permit golf cart use on designated sidewalks with proper signs. As of now, Manatee County has not mandated where golf carts can go.

Despite the possible changes, law enforcement officials want to remind golf cart drivers they should never travel on roads. They say doing so is not only dangerous, it's also illegal and could result in a ticket.

Also, until the county mandates where golf carts can go, drivers can still be ticketed for traveling on sidewalks in certain areas.

NATIONAL - A federal jury has awarded a couple $1.5 million for injuries the husband suffered after a hernia patch made by the Cranston firm Davol Inc. ruptured in his abdomen. After deliberating about two days, a jury found that the failure of Davol and its parent company, C.R. Bard Inc., to warn about the dangers of mesh patch led to the plaintiff's injuries.  The records reflect that the plaintiff suffered after having a hernia repaired in 2005.  

The jury also found that the patch's poor design caused the couple's suffering.

PLAYGROUND EQUIPMENT | X-Waves | Child's death on playground

NATIONAL - Many school districts have rushed to remove or are considering removal of teeter-totter-like playground equipment called X-Waves after a 9-year-old girl was fatally injured while playing on one.  Those that have not been removed have been temporarily fenced off.

The X-Wave's manufacturer, Xccent, "refused to discuss" the matter. The X-Waves look like three teeter-totters joined end to end by a flexible polymer material that allows the bench seats to go up and down without pinching.

ANOTHER DISNEY BUS CRASH near Hollywood Studios | 26 passengers onboard | Disney Transportation

LAKE BUENA VISTA - A Disney Transportation bus and a PT Cruiser crashed yesterday near Hollywood Studios.  This accident caused some minor traffic delays.  The crash was reported as "minor" by authorities.

According to the Reedy Creek Fire Department, there were 26 passengers onboard the bus at the time of the accident.  None of the passegers required transport to local hosptials from the scene.

AUTO ACCIDENT | Mazda recalls vehicles with potential power steering fault | Crashes

NATIONAL - According to the Chicago Tribune (8/18) reports that Mazda "is recalling 215,000 Mazda3 and Mazda5 vehicles to fix problems with the power-steering system that could lead to a crash," saying that the "vehicles could have a sudden loss of power-steering assist, making it more difficult for the driver to steer the vehicle. The automaker says that could increase the risk of a crash."

Parents Warned: Bounce Houses Pose Lead Hazard to Children

NATIONAL - An investigation by the Center for Environmental Health (CEH) has prompted lawsuits to be filed today by CEH and the California Attorney General against leading makers, distributors and suppliers of bounce houses (also called jump houses or inflatable jumpers). CEH testing found one bounce house contained more than 70 times the federal limit for lead in children’s products under the Consumer Product Safety Improvement Act. Independent testing commissioned by CEH also showed that lead from bounce houses can expose children to the toxic chemical at levels that violate California law. 

“Parents expect that their children might be a little dizzy after a jumping session, but most parents would never suspect that a bounce house could pose a hidden health threat,” said Michael Green, Executive Director of CEH. “We look forward to working with the Attorney General to eliminate these unnecessary lead exposures to children.”

The companies to be sued today supply bounce houses to many retail bounce house party outlets as well as to independent companies that rent and deliver bounce houses to individuals, festivals and events.

Bounce houses are often made with vinyl (polyvinyl chloride, or PVC), a “poison plastic” that is often made with lead, a neurotoxin that can cause learning disorders, brain and nerve damage, hearing problems, stunted growth, and digestive problems. Scientists are increasingly convinced that there is no safe level of lead exposure, especially for young children.
