NATIONAL - According to The New York Times (8/10, A15, Pear) reports, "The Obama administration is investigating pay practices throughout the health care industry after finding that many hospitals and nursing homes do not pay proper overtime to nurses and other employees who work more than 40 hours a week."

Many "hospitals around the country have paid millions of dollars in back wages to settle claims by the government and their employees," and several others "are fighting class-action lawsuits that raise the same issues." Meanwhile, the "Labor Department has hired 250 new wage-and-hour investigators, representing a staff increase of one-third," because the "government wants to make sure workers get 'every penny they earn,'" said Kenneth Stripling, an official with the department.

Litigation seen as growing over on-call employees who claim restriction of freedom. - The National Law Journal reports, "On-call employees are turning into a growing liability risk for employers, as some are claiming that companies are restricting their freedom too much, and not paying them for it."

Now, "employment lawyers say that such claims are popping up in larger wage-and-hour class actions, with on-call employees suing for unpaid overtime, alleging that their freedom has gotten so limited that they may as well be hourly employees." Julie A. Dunne, a labor attorney said, "It's definitely triggering litigation." She added, "the key for employers is to make sure they're not overly restricting on-call employees' freedom."

Judge approves $39 MILLION SETTLEMENT between Wachovia and brokers - FAILURE TO PAY OVERTIME AND WAGES

The National Law Journal (5/13, Bronstad) reported, "A federal judge in Los Angeles has approved a $39 million preliminary settlement to resolve the multidistrict litigation between Wachovia Corp. and more than 10,000 stock brokers who alleged that they were denied overtime pay and other wages."
