STATEWIDE - Florida lawmakers finally passed a bill banning texting and driving in this state. While this bill is certainly a step in the right direction, there is much room for improvement and strengthening of the law. The law passed by the legislature bans texting and driving on Florida roadways, subject to a number of exceptions. 

Texting while driving is considered a secondary offense, meaning that a driver must be have committed another traffic infraction in order to be pulled over and only then can be issued a ticket for texting and driving. A first offense results in a $30 ticket. A second offense carries a $60 fine and three points on a driver's license. Drivers who use hands-free, voice activated texting don't have to worry about a fine. You can also text while your car is stopped at a red light or if you're in a traffic jam. While the law isn't perfect and there may be difficulty enforcing it, most believe it is a necessary first-step in working towards keeping our roads safer and saving the lives of countless people.

According to a report from the Florida Department of Highway Safety and Motor Vehicles, 4,481 crashes out of a total of 256,443 in 2012 involved a driver who had been texting or otherwise using an electronic communication device while driving.

NATIONAL - In a recent survey, experts have discovered that more teens are texting while driving.  Because teens are using cell phones more than ever before, many are using cell phones in ways that are dangerous, with more than a third admitting that they have sent a text message while driving.

Using a cell phone while driving is often a recipe for disaster. According to information from the National Highway Traffic Safety Administration (NHTSA), in 2009, 995 of 5,474 traffic accident fatalities involved reports of a cell phone as a distraction. In fact, cell phone use played a role in 18 percent of all fatal distracted driving crashes.

Texting while driving increases your risk of an accident much more than previous studies have concluded. This is as a result of motorists taking their eyes off the road longer than they do when talking or listening on their cell phones.

A study by the Virginia Tech Transportation Institute used cameras to continuously observe light vehicle drivers and truckers for more than 6 million miles. VTech's study found that when drivers texted, their collision risk was 23 times greater than when not texting.

Jury awards 21 MILLION DOLLARS in damages in a Wrongful Death case

The jury found the defendant grossly negligent for texting while driving and causing a fatal crash. The unanimous verdict is one of the largest to be obtained in a texting-while-driving case. 

The subpoenaed the phone records discovered that the defendant had made seven (7) phone calls and sent fifteen (15) text messages during the 45 minutes he was on the road. Some of the messages were sent and received moments before the crash.

According to BAYNEWS 9 - A teenager was cited Wednesday after police said she crashed into a patrol car while she was texting and cutting school.

According to reports, just before 11 a.m. Wednesday, Officer Tanya Manning was stopped at a red light at the intersection of Bruce B. Downs and Palms Springs boulevards in Tampa when she was hit from behind by a car driven by 18-year-old Katelyn Blaylock.

Police said Blaylock was texting at the time of the accident. They also said she had two other teenage girls in the car with her, and that all three teenagers were skipping classes at Freedom High School at the time. Blaylock and one other passenger were slightly injured when the airbags of her car deployed. Manning was not hurt.

Blaylock was cited for careless driving. All three teenagers were taken to their high school and delivered to the assistant principal. All of their parents have been notified.
