TOYOTA / LEXUS - Largest Recall in Toyota's history - 102 Reported incidents

NATIONAL - NHTSA said it "had received reports of 102 incidents in which the accelerator may have become stuck on the Toyota vehicles involved."

According to FORBES - "The impending U.S. recall, the largest in Toyota's history, followed a horrific crash last month in San Diego in which a mat was suspected of snagging a gas pedal on a runaway Lexus, ending with a fiery crash that killed four family members. A minute before the crash, the driver called police to say the car had no brakes and the accelerator was stuck. The runaway car was doing more than 120 mph when it hit a sport-utility vehicle, launched off an embankment, rolled several times and burst into flames."

Toyota/Lexus to recall 3.8 million vehicles – Floor mats may cause accelerator to stick and cause a crash

NATIONWIDE - Toyota is in the process of recalling 3.8 million vehicles in the United States. The problem is a removable floor mat. The floor mat could interfere with the vehicle's accelerator and cause a crash.

The company says it will be the largest recall in its history. Toyota owners could learn about the safety campaign as early as next week.

The recall affects the following vehicles: 2007-2010 model year Toyota Camry, 2005-2010 Toyota Avalon, 2004-2009 Toyota Prius, 2005-2010 Tacoma, 2007-2010 Toyota Tundra, 2007-2010 Lexus ES350 and 2006-2010 Lexus IS250 and IS350.

TWENTY FIVE FHP TROOPERS work three crashes on I-75, I-275 and I-4 involving 131 vehicles

Hillsborough / Polk County — UPDATE — Fifty (50) crashes on three major highways involving 131 vehicles with more than a dozen people sent to hospitals. It all happened over a five-hour period on a Sunday afternoon. The FHP cites wet roads and heavy traffic as the common causes of these accidents.

Just after 3:00 p.m. on Interstate 75 – Northbound, One crash caused seven (7) others, including one involving a church charter bus with more than 40 people aboard. Nineteen (19) vehicles were involved, and six (6) people went to local hospitals. Northbound I-75 was closed for about three (3) hours. Traffic was re-routed off Interstate 75 at State Road 60 near Brandon.

Just before 5:00 p.m., Twenty three (23) more crashes happened on Interstate 4 Westbound, about three miles west of U.S. 27 in Polk County. That pileup involved forty eight (48) vehicles. As a result of these crashes, four (4) people were hospitalized. The traffic back up was not as bad as on I-75 northbound.

Then, shortly after 5:00 p.m., more collisions were reported on Interstate 275 – Southbound on the Howard Frankland Bridge just west of Kennedy Boulevard. This eight (8) vehicle crash caused eleven (11) accidents with more than sixty four (64) vehicles involved. As a result of these crashes, four (4) people were hospitalized. The southbound traffic was limited to just one lane of passage as the vehicles were untangled and moved off the bridge. Just before 9:00 p.m. the traffic flow resumed to normal.

MERCK is paying over 3,100 death claims under VIOXX settlement

NATIONAL - According to Bloomberg News, "Merck & Co. is paying claims by the families of more than 3,100 users of its Vioxx [rofecoxib] painkiller who died of heart attacks or strokes blamed on the drug, according to a law firm administering a $4.85 billion settlement fund."

The company is paying "about 3,000 claims for heart attack deaths and at least 122 strokes," BrownGreer LLP, the claims administrator, said. The drug was "introduced...in 1999" and withdrawn "in 2004 when a study showed the drug doubled the risk of heart attacks and strokes.

Merck set up the fund, which covers claims of death and lesser injuries, in 2007 after reserving $1.9 billion to fight 26,000 Vioxx suits." BrownGreer said that "families of heart attack victims who died will get an average payment of about $374,000."

RAIN - DRIVER INATTENTION causes 31 vehicle pile up Interstate-4 - County Road 557 and U.S. 27 in POLK COUNTY between Tampa - Disney World

POLK COUNTY - A multivehicle crash closed one lane of Interstate 4 westbound at U.S. 27 on Sunday afternoon, backing up traffic for six miles. The first of 23 crashes happened at 4:43 p.m. and caused a chain reaction. Altogether, 48 vehicles were involved, the Florida Highway Patrol reported.

FHP officials said there weren't any fatalities in the crash, but four people were taken to local hospitals with non-life-threatening injuries. Two of the victims were taken by ambulance to Lakeland Regional Medical Center and two to Heart of Florida Hospital. The vehicles were moved to the side of the road by 5:30 p.m., and all westbound lanes were reopened.

All of the crashes remain under investigation.

The series of collisions were spread along a nearly two-mile stretch of the interstate, not far from where a massive I-4 pileup occurred in January 2008 when five people were killed and 70 vehicles were involved in crashes as smoke and fog hindered visibility.

50 vehicle crash Howard Frankland Bridge ♦ REAR ENDED ♦ 50 car pile up

TAMPA — Seven (7) to eight (8) individual crashes caused about fifty (50) vehicles to pile up on the Howard Frankland Bridge. This massive accident took place soon after the Tampa Bay Buccaneers game let out from Raymond James Stadium in Tampa. Southbound Interstate 275 was backed up for nearly three hours as the Florida Highway Patrol investigated these accidents.

Traffic began moving around 7:30 p.m. after the debris and vehicles were moved from the highway. It was not clear how many people were injured, but Pinellas County EMS took three people to local hospitals for treatment of their accident-related injuries.

Kohl's and Ross Stores pay almost 1 MILLION dollars

WASHINGTON, D.C. – The U.S. CONSUMER PRODUCT SAFETY COMMISSION (CPSC) announced that KOHL’S DEPARTMENT STORES INC., of Menomonee Falls, WI, has agreed to pay a civil penalty of $425,000.00. Denture Creams May Cause Nerve Damage, Neuropathy - Poligrip and Fixodent

PEDESTRIAN HIT BY CAR while trying to cross ROOSEVELT BLVD. in Clearwater ♦ Pinellas Sheriff ♦ Florida Highway Patrol investigates

PINELLAS COUNTY – Twice in a month, a pedestrian has been hit and killed as he tried to cross Roosevelt Boulevard in Pinellas County. The accident happened on Saturday night at about 11 p.m. Law enforcement officials said the man was killed when he was hit by an automobile as he tried to cross Roosevelt Boulevard near 59th Street. The pedestrian was pronounced dead at the scene. The driver of the car stopped after the accident.

Officials have not said whether any charges will be filed in the case. The street was closed for several hours while deputies investigated the scene.

Woman seriously injured by Pit Bull • Dog attack in St. Petersburg • Listed in serious condition

PINELLAS COUNTY – According to a report on BayNews 9, law enforcement officials say a dog attacked and seriously injured a woman Thursday afternoon. St. Petersburg police said the dog, which they described as a 100-pound pit bull, attacked a woman as she walked into her backyard.

The woman suffered gashes on her left arm and injuries to her head, neck, right shoulder and right arm and was taken to Bayfront Medical Center.

Officials said she is listed in serious condition.

Federal judge DENIES Toyota's bid to seal whistleblower lawsuit

NATIONAL - Toyota Motor Corp.'s request to seal a U.S. lawsuit by a former in-house attorney claiming the carmaker destroyed crash data was denied yesterday by a judge who said the suit was already 'irreversibly' public. The suit, filed in July by Dimitrios Biller, a former Toyota in-house lawyer, claims the world's largest automaker hid engineering and testing results in more than 300 car- rollover cases.

The company is 'disappointed' with the decision, said Mike Michels, a Toyota spokesman. 'We remain confident that we have acted appropriately in product liability cases and in all reporting to federal safety regulators,' Michels said. 'The court's decision does not affect the fundamental aspects of the case in any way.'"

Fatal crash prompts Toyota-LEXUS to order floor mat inspections

NATIONAL - According to the San Diego Union-Tribune, “Toyota said Tuesday it will order all dealers to inspect their cars for mismatched floor mats after a mat was suspected of snagging a gas pedal on a runaway Lexus, ending with a fiery crash that killed four family members in San Diego County."

The piece notes that the family was riding in a loaner car from a Lexus dealership. "Investigators with the National Highway Traffic Safety Administration have determined that a rubber all-weather floor mat found in the wreckage was slightly longer than the mat that belonged in the vehicle. That could have snared or covered the accelerator pedal."

BICYCLIST is critically injured in collision with U S Postal Service mail truck on Gulf Boulevard in BELLEAIR BEACH

BELLEAIR BEACH — A bicyclist was in critical condition last night after running into a parked U.S. Postal Service delivery truck. Authorities said a medical helicopter took the 55-year old bicyclist to Bayfront Medical Center after the incident, which occurred just before 3:30 p.m.

The man was riding his bicycle south on Gulf Boulevard when, for an unknown reason, he crashed into the back of the mail truck, parked in front of a home at 1720 Gulf Blvd. The truck's lights were on and flashing, according to a news release from the Pinellas County Sheriff's Office.

The man sustained possible life-threatening injuries to his neck and head, officials said. Witnesses said he was wearing a helmet.

The Pinellas County Sheriff’s Major Accident Investigation Team is investigating.

City of Seminole - Councilors support new traffic light at Park Street and Burning Tree Drive

SEMINOLE – City of Seminole officials passed a resolution Sept. 3 supporting the installation of a traffic light at the intersection of Park Street and Burning Tree Drive at the entrance to the Seminole Lake community.

According to county officials, the Burning Tree/Park Street intersection was the site of 25 crashes over the past five years and 20 of those accidents were considered avoidable with a traffic signal.

At least one injured in Pinellas Park motorcycle accident • Belcher Road at 78th Avenue

PINELLAS PARK — At least one person was injured in an accident Tuesday night at Belcher Road and 78th Avenue N, officials said. The accident, which occurred just after 11 p.m., involved a motorcycle.

One person was taken to the hospital as a trauma alert.

Pinellas Park police are investigating. No other details were available late Tuesday night.

Some consumers suing banks over debit overdraft fees

According to the The New York Times (9/9, A1, Lieber, Martin) reports on the increased incidence of banks charging hefty fees when customers overdraw their accounts with debit card purchases, noting that "this year alone, banks are expected to bring in $27 billion by covering overdrafts on checking accounts, typically on debit card purchases or checks that exceed a customer's balance. In fact, banks now make more covering overdrafts than they do on penalty fees from credit cards." The piece notes that federal legislators and regulators are proposing curbs on such fees.

Meanwhile, the Times describes a Florida lawsuit in which the plaintiff alleges that Bank of America changed the chronology of a number of his purchases to increase the number of overdraft fees it could charge him. Such "lawsuits open a window onto the questions that government officials and banks are now trying to answer."

ULTRA LIGHT PLANE CRASH off John's Pass in Boca Ciega Bay – Resulting in two fatalities - Treasure Island - Madeira Beach

PINELLAS COUNTY - Two men are confirmed dead in the crash of an Ultra-light aircraft that went down in Boca Ciega Bay off John's Pass, according to the Pinellas County Sheriff's Office. The Coast Guard was contacted shortly after 9:30 a.m. by someone who saw what looked like an airplane heading toward the water off John's Pass, according to Coast Guard spokesman Petty Officer Robert Simpson.

Crews from the Coast Guard, Florida Fish and Wildlife, the Pinellas County Sheriff's Office, St. Petersburg Fire and Rescue and Eckerd College all participated in the rescue attempt. Both bodies have been recovered.

The Federal Aviation Administration will be conducting an investigation.

I-4 at State Road 434 Crash Ties Up Traffic ♦ Seminole County ♦ Longwood ♦ FHP investigation

SEMINOLE COUNTY -- A crash on Interstate 4 in Seminole County shut down all eastbound lanes for more than an hour early Saturday morning. Two cars collided around 4:45 a.m. just past the State Road 434 exit in Longwood.

According to Seminole County Fire and Rescue, one person was slightly entrapped in one of the vehicles, and another was taken to Orlando Regional Medical Center. There was no immediate word on the severity of the injuries of those involved.

Florida Highway Patrol troopers continue to investigate what caused the crash.

Chinese drywall trials to begin January 2010 • Number of implicated Chinese drywall manufacturers may be about to jump sharply

According to the Sarasota Herald Tribune (9/4, Kessler) reports, "The number of Chinese drywall manufacturers responsible for corrosion and potential health problems plaguing U.S. homeowners may be about to increase substantially." On Thursday, lawyers involved in the case "revealed that 36 separate variations of tainted drywall have been found -- a much higher number than previously disclosed." New players "revealed in photographs filed with the court show names such as Crescent City Gypsum Inc., International Materials Trading, ProWall and Dragon Brand Drywall." The disclosure came "as U.S. District Court Judge Eldon E. Fallon, who is overseeing the multidistrict litigation, warned one of the Chinese manufacturers already identified -- Taishan Gypsum Co. Ltd. -- that he would issue a default judgment if it did not respond in the case."

Furthermore, the judge plans to begin Chinese drywall trials in January. According to the AP (9/3, Kunzelman) reported that U.S. District Judge Eldon Fallon, who is "presiding over hundreds of lawsuits against Chinese drywall makers and installers, said Thursday that he plans to hold the first trial in January for the cases." Fallon "told attorneys that he expects them to pick six plaintiffs whose cases could be tried in early 2010, with the first trial starting in January. Kerry Miller, a lead lawyer for companies named as defendants in the suits, said defense attorneys may need more time to prepare for the first batch of bellwether trials. Russ Herman, a lead plaintiffs lawyer, said he supports Fallon's scheduling plan." Herman "estimated that plaintiffs lawyers represent between 12,000 and 20,000 clients with claims."

NHTSA investigating Honda regarding airbag recall

NATIONWIDE - In a blog at the New York Times (9/3), Christopher Jensen reported, "The National Highway Traffic Safety Administration is investigating whether Honda delayed the recall of almost 440,000 vehicles for an air bag defect that could allow shards of metal to hit the driver.

Last November, Honda notified the safety agency that it was recalling about 3,900 - 2001 Accords and Civics because the air bag inflator on the driver's side might be too powerful." Then in July, Honda expanded the recall to include "about 440,000 vehicles." But in a recent letter, NHTSA "had a lot of questions about why last year's recall was so small and suddenly grew so much."

OfficeMax Recalls Tasks Chairs Following Injury Reports Model numbers OM182 and OM96614

NATIONWIDE - OfficeMax Inc., of Naperville, Ill. is recalling around 216,000 Office Max Task Chairs because of a fall hazard. According to the recall notice, OfficeMax has received about 35 reports of the chair backs or posts breaking, including 15 reports of injuries involving lacerations, muscle strains, contusions and concussions.

The recall involves OfficeMax Task Chairs with model numbers OM182 and OM96614. The model number is located under the chair’s seat on a white UPC label. The chairs are charcoal or dark charcoal in color and have black plastic arms and a rolling plastic and metal base.
The Task Chairs were sold in OfficeMax stores nationwide, on the firm’s Web site www.officemax.com, in OfficeMax catalogs, and through direct commercial sales to businesses from September 2003 through July 2008 for between $40 and $65.

Florida Lt. Governer Jeff Kottkamp joins Chinese drywall suit.

FT. MYERS - The South Florida Business Journal (9/2, Brinkmann) reported, "Lt. Gov. Jeff Kottkamp has joined hundreds of other Floridians in filing suit over defective Chinese drywall in his home." He and his wife, "Cynthia Kottkamp, filed federal suit Monday in Fort Myers against manufacturer Knauf Gips KG and Knauf Plasterboard Tianjin Co.

The couple alleges that the drywall in their North Fort Myers home has corroded their air conditioner and is making them sick."

Trial Lawyers say, 28,000 Truckers Violate Safety Rules • Truckers need to RAISE INSURANCE LIMITS

NATIONWIDE - A new analysis of government data reveals that more than 28,000 motor carrier companies that operate 200,000 trucks have violated federal safety regulations. According to the FMCSA, more than 4,000 people die every year in collisions with trucks and 80,000 more are seriously injured. Also, though trucks make up less than four percent of all passenger vehicles on U.S. roads, they are involved in 12 percent of all motor vehicles fatalities.

The trial bar association, the American Association for Justice (AAJ), said it found commuters are sharing roads with trucks that have incurred thousands of safety violations, such as defective brakes, bald tires, loads that dangerously exceed weight limits and drivers with little or no training or drug and alcohol dependencies.

AAJ also maintains that the minimum insurance requirements for commercial trucks are "completely inadequate to compensate those who have been seriously injured in a collision involving multiple vehicles or multiple injured individuals." In 1980, Congress set the minimum level of insurance to $750,000; when adjusted for inflation, $750,000 is just $292,000 in 1980 dollars, according to the analysis.

While large trucking companies may carry more than the required level of coverage, smaller companies often carry just the bare minimum. Whistleblower lawsuit accuses Toyota of concealing evidence in hundreds of rollover accidents.

According to the LA TIMES, "Toyota spent years concealing evidence from victims of hundreds of rollover accidents that resulted in death and injury, a former top lawyer for the automaker says." Dimitrios P. Biller of Pacific Palisades, "a former managing counsel for Toyota Motor Sales USA Inc., said in the suit that the company repeatedly forced him to illegally withhold information from opposing lawyers and made him resign in September 2007."

In the July 24 lawsuit filed in federal court in Los Angeles, "Biller accuses the world's largest automaker of destroying data in more than 300 accidents that proved vehicle roofs were substandard." Clarence Ditlow, executive director of the Center for Auto Safety, "said that if what Biller says is true, the financial repercussions for Toyota could be massive."
