PUT PATIENTS FIRST - 98,000 reasons why - MEDICAL MALPRACTICE

Accordiing to the Institute of Medicine, 98,000 people die every year from preventable medical errors - and this number doesn't include those seriously injured.  This is the sixth leading cause of death in America, equivalent to two 737's crashing every day.

Trial attorneys see first-hand the effects medical errors have on patients and their families.  The best way to have fewer medical malpractice cases is to reduce the number of medical errors.  If less people need to seek legal recourse, that means patients are getting safer.  Patients that are safer also means lower costs to the health care system.

Everyone can support this.

WARNING - Medical Malpractice Victims: Your Rights are in Danger

Insurance companies, the American Medical Association and other powerful interests say that our health care system is in crisis because of a rising tide of medical malpractice claims.

Their solution is to put a “cap” on the amount innocent victims of medical malpractice can recover for their injuries. In fact, “caps” are not the answer and lawsuits are not the problem.

Arbitration: Tricking People Out of the Right to a Trial by Jury

Buried in the fine print of most consumer contracts - such as credit cards, insurance plans and car deals - is a clause, which waives the buyer’s constitutional right to trial by jury.

These contracts mandate that consumers give up their rights before a dispute even occurs - this is called "mandatory, binding, pre-dispute arbitration." Arbitration was conceived as an informal, expedited process for resolving routine disputes between businesses. But when it is imposed on a weaker party, such as a consumer, arbitration can be used to defeat valid claims.

Arbitration has several unique characteristics that stack the deck against consumers, making it harder for individuals to prevail in a dispute with a business.

The Truth about Lawsuits

Big Corporations and Their Powerful CEOs Say the Legal System Is In Crisis - They claim that lawyers and “frivolous” lawsuits are clogging the courts, bankrupting large corporations and costing our economy thousands of jobs.

The Real Crisis: Your Rights Are Under Attack

In fact, the real reason these special interests support so-called tort “reform” is so they can limit the rights of regular Americans to hold them accountable when they cause harm. They don’t want to be held accountable, because it costs them money and reduces their profits.

Hospital Infections Kill Nearly 50,000 a Year

NATIONAL - The above is a headline from the February 23rd, 2010 issue of the New York Daily News. The article reports on a study published in the Archives of Internal Medicine on February 22, 2010. The study and resultant articles point out that approximately 48,000 patients die each year from pneumonia or blood poisoning picked up in hospitals.

In this study, hospital discharge records were looked at on 69 million patients who were in hospitals in 40 US states between 1998 and 2006. The records were examined to look for blood infections or pneumonia. Problems of these types that were acquired from outside the hospital were excluded, so that the data only showed problems resulting from a stay at the hospital.

The results of this large study brought forth some alarming data. The study revealed that hospital-acquired illnesses were responsible for 2.3 million extra patient days in hospitals. These extra days in a hospital resulted in a cost of $8.1 billion in the year 2006 alone. Overall, 1.7 million healthcare-associated infections are diagnosed every year.

Ramanan Laxminarayan, spokesperson for Resources for the Future, the group that sponsored the study, reacted to the high rates of infection by saying, "In many cases, these conditions could have been avoided with better infection control in hospitals."

One of the researchers on the study, Anup Malani, from the University of Chicago, added, "That's the tragedy of such cases. In some cases, relatively healthy people check into the hospital for routine surgery. They develop sepsis because of a lapse in infection control and they can die."

FLORIDA SEATBELT LAWS ♦ Click it or Ticket ♦ Seat belts save lives

STATEWIDE – March 1 – 15 will be the "Click It or Ticket" safety-belt enforcement campaign statewide. The crackdown will be looking for drivers and passengers – including children younger than 18 - will be ticketed if they aren't buckled.

The Pasco County Sheriff’s Office, Zephyrhills Police and Dade City Police are joining the Florida Highway Patrol and Florida Department of Transportation in "Click It or Ticket" safety-belt enforcement campaign. During the campaign, some agencies will be conducting seat-belt checkpoints both day and night looking for violators.

Thirty percent of Florida traffic fatalities are due drivers and passengers to failing to buckle up. Safety belts are eighty percent effective in reducing fatalities in light trucks, including sport utility vehicles, during rollover crashes. According to law enforcement officials, seatbelts also help prevent individuals from being totally ejected during a crash, reducing the risk of a fatal injury.

Florida Injury Attorney G. Alan Tripp and the injury law team at the Tripp Law Firm encourages you to “Buckle Up.” http://www.trippfirm.com/
