CPSC announces RECALL of Simplicity and Graco cribs – DANGER for babies

This week the government has recalled thousands of Simplicity and Graco cribs issuing a warning that babies could suffocate or strangle in them. The Consumer Product Safety Commission (CPCS) said the Simplicity recall was linked to at least one death and involved thousands of cribs, possibly hundreds of thousands, though many had previously been recalled for other defects.

217,000 Graco dropside cribs made by LaJobi were also being recalled.


Consumers should immediately stop using the recalled cribs. The CPSC urges parents and caregivers to immediately find an alternative, safe sleeping environment for their baby.

Fatal AMTRAK train crash blamed on possible gate and or light malfunction

According to Federal Investigators, the gates and warning lights at a railroad crossing weren't functioning properly and may have been turned off when an Amtrak train fatally struck a teacher.

The Federal Railroad Administration’s investigation revealed witness accounts and video footage which has confirmed the active warning system was not working when the train struck and killed the driver of the SUV.

Sovereign Immunity Limits have been Increased by 2010 Florida Legislature ♦ Awaits Governor Charlie Crist’s signature

The Florida Legislature increased the limits of liability from $100,000 per person/$200,000 per incident, to $200,000/$300,000 per incident. For nearly thirty years the limits were set at $100,000/$200,000. This limit was the maximum amount government entities can be forced to pay to victims in personal injury cases.

Citrus County Boating Accident Withalacoochee River

CITRUS COUNTY - The Florida Fish and Wildlife officials are investigating the death of a woman on the Withlacoochee River.

The boating accident happened just before 4:30 p.m. near the Citrus-Sumter County border. The 25-year-old woman fell off the pontoon boat she was riding in, and was struck by the propeller. She reportedly died from her injuries.

The investigation continues.

Lawsuits filed against makers of Yasmin, Yaz – Blood clots – DVT’s - Stroke

NATIONAL - A flurry of law suits have been filed against Bayer HealthCare the makers of Yasmin & Yaz.  Many of the attorneys claim that the progestin" drospirenone "contained in the" oral contraceptives Yasmin and Yaz (both drugs drospirenone & ethinyl estradiol), "is the cause of health problems, including deep vein thrombosis (blood clots in the deep veins), strokes, heart attacks, and gallbladder disease."

Some "research on the issue is divided," however, because "some studies have found" that drospirenone "poses no greater health risk than other birth control pills," while others "show a six-fold greater risk of getting blood clots, even in young, healthy women."

WORKERS' COMP - Injured Workers' DRUG COSTS higher in Florida than other states

According to a new study by the Workers Compensation Research Institute (WCRI), the payment per claim for prescription drugs used to treat injured workers in Florida was nearly 40 percent higher than in most study states.  BUT WHY?

WCRI found that the average payment per claim for prescription drugs in Florida's workers' compensation system was $565—38 percent higher than the median of the study states. 

The main reason for the higher prescription costs in Florida was that some physicians wrote prescriptions and dispensed the prescribed medications directly to their patients. When physicians dispensed prescription drugs, they often were paid much more than pharmacies for the same prescription.

Jury awards 21 MILLION DOLLARS in damages in a Wrongful Death case

The jury found the defendant grossly negligent for texting while driving and causing a fatal crash. The unanimous verdict is one of the largest to be obtained in a texting-while-driving case. 

The subpoenaed the phone records discovered that the defendant had made seven (7) phone calls and sent fifteen (15) text messages during the 45 minutes he was on the road. Some of the messages were sent and received moments before the crash.

SPINAL FUSION SURGERY - May put elderly patients at RISK

NATIONAL - Spinal fusion surgery may put elderly patients at risk.  According to a new survey, risky spinal fusion surgeries are increasingly being performed on elderly patient.  The spinal fusion surgeries, which often use devices made by Medtronic Inc. and Zimmer Holdings Inc., often lead to life-threatening complications in these patients.

One facet of this study looked at the rate of spinal surgery and its complications and cost in a large group of Medicare patients.

The study also uncovered that spinal fusion patients showed a doubled rate of life- threatening complications, 5.6 percent, compared with a simpler back surgery called decompression. The more complicated surgery generated average hospital charges of $80,888 compared with an average of $23,724 for the simpler operation.

NATIONAL - According to an Associated Press (AP) investigation, Toyota has routinely engaged in questionable, evasive and deceptive legal tactics when sued, frequently claiming it does not have information it is required to turn over and sometimes even ignoring court orders to produce key documents.

In a review of lawsuits filed around the country involving a wide range of complaints -- not just the sudden acceleration problems that have led to millions of Toyotas being recalled -- the automaker has hidden the existence of tests that would be harmful to its legal position and claimed key material was difficult to get at its headquarters in Japan. It has withheld potentially damaging documents and refused to release data stored electronically in its vehicles.

There have been numerous cases around the country in which Toyota's actions were evasive, and sometimes even deceptive, in providing answers to questions posed by plaintiffs. Court rules generally allow a person or company who is sued to object to turning over requested information; it's permitted and even expected that defense attorneys play tough, but it's a violation to claim evidence does not exist when it does.

Toyota disputes this statement and the accusations of deception. Toyota says, “it plays by the rules when it comes to defending itself.” "Toyota takes its legal obligations seriously and strives to maintain the highest professional and ethical standards, in connection with litigation and otherwise,'' the company said, "We are confident we have acted appropriately with respect to product liability litigation.''

SEMINOLE FIRE RESCUE - Pinellas County Sheriff's Office - Road Rage - 113th Street and 102nd Avenue

PINELLAS COUNTY - Seminole Fire and Rescue and the Pinellas County Sheriff's Office responded to a road rage incident that began at 113th Street and Park Boulevard and ended at 113th Street and 102nd Avenue.

One man was airlifted by Bayflight to Bayfront Medical Center with serious injuries.  Three (3) people were arrested, two (2) were charged with felony aggravated battery and the third as was charged with accessory after the fact.

Yaz, Yasmin Updated Labels now to Include Information on Possible Blood Clots

NATIONAL - New safety information regarding the risk of blood clots has been added to the labels of Yaz and Yasmin, Bayer Healthcare’s popular birth control pills. The label update comes as Bayer faces at least 1,100 lawsuits filed by women who claim to have been injured by either Yaz or Yasmin.

Yaz and Yasmin are both made with a type of progestin called drospirenone, making them different from many other oral contraceptives. Drospirenone can elevate the body’s potassium levels, which can lead to a condition called hyperkalemia in certain patients. Hyperkalemia may result in potentially serious heart and health problems.

Adverse Events reported to the U.S. Food & Drug Administration (FDA) involving Yaz and Yasmin include heart arrhythmias, electrolyte imbalance, hyponatremis, hyperkalemia, hyperkalemic arrhythmias, atrial fibrillation, tachycardia, bradycardia, myocardial infarction, stroke, transient ischemic attack, blood clots, embolisms, and sudden death.

NATIONAL - According to a recent article published in USA Today, State Farm Insurance Companies will be seeking repayment from Toyota on unintended acceleration claims. 

"Armed with reports of accidents for which they've already paid claims, State Farm insurance has asked Toyota to repay them for any crashes related to unintended acceleration by its vehicles." Other insurance companies "are expected to follow and demands for repayment of claims - called 'SUBROGATION' in the insurance business - could end up costing Toyota from $20 million to $30 million . . ."

The article goes on to say, "If Toyota doesn't end up paying for accidents insurers link to sudden acceleration, the cost could trickle down to consumers, who could end up paying higher insurance rates for Toyota vehicles."

$10 Million Dollar Jury Verdict in Florida ♦ Baby left with Cerebral Palsy ♦ Lack of Oxygen to brain

VOLUSIA COUNTY - A jury has awarded $10 million dollars to a woman who sued an ambulance transport service over injuries her son received during his premature birth. This is in addition to the lawsuit that was settled against the hospitals and doctors last year for $1.4 million dollars.

This complex case was given to the jury to decide the amount of damages for the mother who gave birth en route to the hospital and to her son who was left with cerebral palsy after suffering a lack of oxygen to the brain.

The verdict will likely be appealed.

ANOTHER HIT FOR TOYOTA - NHTSA seeking $16 MILLION DOLLAR FINE for sticky Toyota gas pedals.

NATIONAL - The NHTSA will seek the maximum possible penalty from Toyota-over $16 million-in its faulty accelerator case generated significant coverage, with reports on all three network news broadcasts and heavy reporting in major papers, wire services, and news sites.


ABC World News reported that the government "accused Toyota of, in essence, a cover up, proposing to hit the company with a $16 million fine. The announcement said Toyota had five days to report problems with sticking gas pedals but instead waited months to take action."


A former NHTSA administrator called the announcement a "black eye" for the automaker, and adds that Toyota was "blasted" "for knowingly hiding a dangerous defect. Toyota has been accused of failing to 'take action to protect millions of drivers and their families.'"

According to the Washington Post, if the fine is approved, it would represent the largest financial penalty imposed by the U.S. government on an automaker. Furthermore, the fine could rise" should the government find other related violations on Toyota's part. If the government's ongoing investigation into runaway Toyotas turns up violations related to other defects, perhaps more fines may be on the horizon for Toyota.

Some have said, “accepting the fine could look like admission of guilt.” Therefore, Toyota faces a dilemma, accept a record $16.4 million fine or continue to fight at the cost of more bad publicity.

DISNEY TRANSPORTATION – Bus Driver charged in 3rd Disney bus crash in 2 weeks – Near Disney's Hollywood Studios

LAKE BUENA VISTA – A Disney Transportation bus driver is accused of causing the third Disney-related bus crash in two weeks. Authorities say the driver of the Walt Disney World bus struck the back of another car from Ohio that was at a stoplight at World Drive and Buena Vista Drive, near the entrance to Disney’s Hollywood Studios. The SUV from Ohio was then pushed into a Disney-owned van.

This marks the third crash on the theme park's property in the past two weeks. A 9-year-old Pinellas County boy was killed while riding his bicycle in the campground when he collided with a Disney bus near the Fort Wilderness Resort.

WALT DISNEY WORLD TRANSPORTATION ACCIDENTS ♦ 2009 - 2010

LAKE BUENA VISTA - April 1, 2010 - A boy riding a bike was hit and killed by a Disney bus near Disney's Fort Wilderness Resort and Campground.  March 23, 2010 - A Walt Disney World bus rear ends a charter bus at the entrance to the Walt Disney World’s EPCOT theme park. Eight people were injured.  Nov. 2, 2009 - A girl was seriously hurt at Fort Wilderness when a golf cart in which she was riding overturned. They swerved to avoid another cart driving toward them without lights.  July 16, 2009 - Two Disney buses collided near Disney's Contemporary Resort. Twelve people were taken to the hospital. One of the bus drivers was charged in the incident.

1 Million Medicare Patients Experience Medical Errors <> Medical Negligence

Nearly one million patient safety incidents occurred among Medicare patients in 2009. This figure almost matches what happened in the years 2006, 2007 and 2008.

According to HealthGrades, an independent healthcare ratings organization, errors cost the federal Medicare program nearly $8.9 billion and resulted in 96,402 potentially preventable deaths from 2006 through 2008. Medicare patients who experienced one or more of the 15 patient safety events had approximately a one-in-10 chance of dying as a result of an event.

Patients at hospitals in the top 5 percent experienced 43 percent fewer patient safety incidents, on average, compared to poorly performing hospitals. If all hospitals performed at this level, 218,572 patient safety incidents and 22,590 deaths could potentially have been avoided, saving $2.0 billion from 2006 through 2008.
