TOYOTA recalling about 400,000 high-end vehicles to fix steering faults | RISK OF CRASH

NATIONAL - According to The Washington Post (7/30, Cha) reports that Toyota announced yesterday the recall of "412,000 Avalons and Lexuses for steering problems, bringing the number of cars recalled around the world since October to nearly 9 million.

The 373,000 recalled Avalons, dating from between 2000 and 2004, have improperly cast steering lock bars that appear to have been a factor in three accidents reported to the company. This problem can cause what Toyota described as a 'minute' crack to develop on the surface. The crack, in turn, can break the bar and lock the steering wheel, increasing the risk of a crash."

A smaller number of Lexus models "have a different steering shaft problem and no injuries have been reported related to this issue, Toyota said."

Toyota's assertions of driver error suggest that BLACK BOXES are more reliable than previously attested

NATIONAL - According the the Los Angeles Times (7/29, Bensinger, Vartabedian) reports that Toyota has often dismissed the data collected by its event data recorders as "unreliable" and collected by "unproven technology. ... Now, facing continued claims that its vehicles are defective, Toyota appears to have done an about-face" and "has been citing data from black boxes in Toyota and Lexus vehicles to suggest that driver error, rather than mechanical or electronic defects, is causing sudden acceleration.

In court cases, regulatory filings and dealings with customers, Toyota has for years branded the devices -called event data recorders, or EDRs - as unreliable. It has also said the tools used to read the reports are prototypes. 'It sounds duplicitous when all along Toyota has been saying this is unreliable, and now they are using it as their defense and they are not releasing the data to the public,' said Henry Jasney, senior counsel at Advocates for Highway and Auto Safety."

NISSAN to recall CUBE over fuel spill fault | Rear-end crash | Serious Injuries

NATIONAL - According to the Associated Press (AP) (7/27, Manning) reports that Nissan has informed NHTSA that it is recalling over 51,000 Cube models in North America "because of possible problems with fuel spilling during rear end collisions," noting that "tests conducted by NHTSA safety regulators found more fuel spilled than federal standards allow.

The spillage occurred during rear end crash tests at 50 miles per hour where the vehicle also spun onto its side."

NYTimes blasts Toyota for failing to comply with NHTSA rules.

According to the The New York Times, "All automakers in the United States are required to report flaws in their vehicles to the National Highway Traffic Safety Administration within five (5) business days of detection," but Toyota "has repeatedly failed to report potentially deadly problems.

The latest omission to be brought to light -- and not by the automaker -- regards problems with steering wheel relay rods, which transmit changes in direction from the steering gearbox to the wheels. ... Toyota has a lot to explain about why it delayed informing American regulators about the faulty rods - and why it told the N.H.T.S.A. it had received no complaints in the United States."

Blue Cross Blue Shield | BCBS plans kept significant reserves while increasing premiums.

NATIONAL - According to USA Today (7/22, Young) reports, "Non-profit Blue Cross and Blue Shield health plans stockpiled billions of dollars during the past decade, yet continued to hit consumers with double-digit premium increases, Consumers Union found in an analysis of 10 of the plans' finances."

Although "insurers must keep surplus money to ensure they can pay policyholders' medical bills if unexpected market conditions develop," the group found that "seven of the plans examined held more than three times the amount regulators consider the minimum needed to do that."

Therefore, Consumers Union is urging "state insurance regulators to scrutinize surpluses when considering rate increases and set maximum limits for surpluses."

Toyota Accused of Planting Driver Error Story | Sudden Acceleration | Injury

NATIONAL - Toyota is being accused of planting a story in The Wall Street Journal asserting that federal regulators were blaming dozens of unintended acceleration incidents involving the company’s vehicles on “driver error.” According to the Web site Just-Auto.com, a spokesperson for the National Highway Traffic Safety Administration (NHTSA) has refuted the claims made in the Journal piece, which was published Tuesday.

Pedestrian hit on Gulf Blvd ♦ MADEIRA BEACH ♦ Pinellas County Sheriff investigates

MADEIRA BEACH — Authorities said, a northbound vehicle struck a woman crossing Gulf Boulevard with a group of friends. The 46 year old resident of Madeira Beach was taken to Bayfront Medical Center for treatment of her accident-related injuries. 

According to the Pinellas County Sheriff's Office, the accident happened just before 10:00 p.m. near the John's Pass Village.

Charges are pending.

QuadSport ATVs recalled by Suzuki ♦ serious hazard of injury or death ♦ Possible Crash

NATIONAL – According to the U.S. Consumer Product Safety Commission (CPSC), American Suzuki Motor Corporation is recalling about 1,355 Suzuki QuadSport All Terrain Vehicles (ATVs) due to loss of control hazard.

The flame arrester screen can become detached from its mounting ring, preventing the throttle valve from returning to the idle position when the throttle lever is released, causing the rider to lose control of the ATV.

This poses a serious hazard of injury or death. To date, American Suzuki has received two reports of flame arrester screens detaching from the mounting ring. No injuries have been reported as a result of this distachment.

Wal-Mart continues to fight the $7,000 OSHA fine in worker's trampling death

NATIONAL - According to Newsday (7/8, Chang) reports, "A crowd management expert testified Thursday that the Valley Stream Walmart lacked adequate crowd control and safety measures in the 2008 Black Friday trampling death of a temporary worker." Wal-Mart "is fighting a $7,000 fine from the federal Occupational Safety and Health Administration (OSHA) after the death of a greeter who died after being trampled by crowds surging into the store for Black Friday sales.

Wal-Mart contends the fine is based on 'a standard that was neither posted nor proposed at the time.'"

The Wall Street Journal (7/9, Zimmerman) reports that the Retail Industry Leaders Association supports Wal-Mart's position. RILA spokesman Brian Dodge said, "The precedent set by this OSHA citation would be far reaching and dangerous to the entire retail industry."

Wal-Mart spent over 1 MILLION in defense costs to vigorously fight a small $7,000 OSHA FINE in 2008 trampling death at one of its retail stores

NATIONAL - On the front page of its Business Day section, the New York Times (7/7, B1, Greenhouse) reports, "Wal-Mart Stores has spent a year and more than a million dollars in legal fees battling a $7,000 fine that federal safety officials assessed after shoppers trampled a Wal-Mart employee to death at a store on Long Island on the day after Thanksgiving in 2008."

The company's "all-out battle against the relatively minor penalty has mystified and even angered some federal officials," but Wal-Mart "says that regulators are trying to enforce a vague standard of protection when there was no previous OSHA or retail industry guidance on how to prevent what it views as an 'unforeseeable incident.'"

Wal-Mart spokesman David Tovar said, "The citation has far-reaching implications for the retail industry that could subject retailers to unfairly harsh penalties and restrictions on future sales promotions."

TOYOTA STALL may cause ACCIDENT | Toyota Recalls 270,000 cars

NATIONAL - Toyota has announced a recall of some 270,000 calls across with "potentially faulty engines" that could stall in traffic. If the car stalls in traffic it could cause or be involved in an accident.

Therefore, the NHTSA "said Toyota had not formally notified it about a recall. Japan's top-selling daily Yomiuri said the company will inform the Japanese transport ministry of a recall on Monday but the paper cited no sources."

Toyota continues  "to scrambled to repair its reputation following the recall of 8.5 million vehicles around the globe because of problems with sticking accelerator pedals and gas pedals that can get trapped in floor mats."

It is that time of year again when the U.S. Consumer Product Safety Commission (CPSC) wants consumers to put safety into play if fireworks are part of their upcoming Fourth of July celebrations.

Thousands of injuries occur with sparklers, firecrackers, and aerials, and some 200 fireworks injuries take place each day during the one-month period surrounding the holiday.

A new CPSC study indicates that in 2009 there were two deaths and nearly 9,000 emergency room visits for injuries resulting from fireworks related incidents. Most fireworks injuries occurred to those younger than 20 and, in many cases, resulted in the loss of a limb.

SUPER ROCKET FIREWORKS | Recall | EXPLOSION | Risk for BURNS and INJURY

Some Super Lightning Rocket Fireworks have been recalled by Big Fireworks, of Lansing, Michigan, due to risk of burn, the U.S. Consumer Product Safety Commission (CPSC) just announced.



The rockets are overloaded with pyrotechnic composition, violating the federal regulatory standard for this product. This could result in a greater-than-expected explosion, posing a risk of burns and bodily harm to nearby consumers. To date, no incidents or injuries have been reported.



This recall involves stick-type rockets with a 1-1/2-inch in diameter engine that is mounted on a 32-inch wood stick. “Super Rocket,” was made in assorted colors, sold in packages of four, and have item number GCR3150 printed on the package and on the rocket engine.



The recalled Super Lightning Rocket Fireworks were sold at fireworks stands and stores in Florida, Indiana, Pennsylvania, and Michigan from November 2009 through June 2010.

Avastin may cause significant kidney damage in some patients

NATIONAL - Today, The Los Angeles Times reported that Avastin (bevacizumab) "can cause significant kidney damage in some patients," according to a new study.

Researchers, "reporting in this month's issue of the Journal of the American Society of Nephrology...wrote that patients on Avastin were at increased risk of severe protein loss from the kidneys, which can lead to permanent damage."

Altogether, "patients on Avastin were at a fourfold risk for protein loss and kidney damage, depending on dosage and the type of cancer."
