Road Construction Accidents - Work Zone Related Crashes on Interstate Highway

NATIONAL - “The number of people killed as a result of crashes in work zones remains significant,” the Federal Highway Administration says on its website

“Safety and mobility impacts from work zones will likely be magnified with the infusion of a large number of new projects.”

Transportation officials are responding pretty much as they always have: by focusing primarily on drivers. States have raised fines for speeding in work zones, cracked down on drunken or distracted drivers and stiffened penalties for killing or injuring highway workers, even though roughly 85 percent of those killed in work zones are motorists.

Why do air bags sometimes fail to deploy during a crash?

NATIONAL - The activation of an air bag in a crash is dependent on several important factors including: the characteristics of the crash (e.g., speed, other vehicle(s) involved, impact direction, etc.); the individual vehicle air bag system's design strategy; and the crash sensor locations. Air bags are not intended to deploy in all crashes. There may be circumstances when an air bag does not deploy. Some possible examples follow:

The crash conditions may be sufficiently moderate where an air bag would not be needed to protect an occupant wearing a seat belt. The seat belt may provide sufficient protection from a head or chest injury in such a crash.

Many advanced frontal air bag systems automatically turn off the passenger air bag when the vehicle detects a small-stature passenger or child, child in a child restraint system, or no occupant in the right front passenger seat.

Some advanced side air bag systems will similarly shut off the passenger side air bag system when detecting a small-stature passenger or child in the right front passenger seat who is positioned too close to the side air bag.

Some vehicles, such as pick-up trucks or sports cars without rear seats, may have a manual ON-OFF switch for the front passenger air bag. If the manual ON-OFF switch is positioned in the "off" position, the front passenger air bag will not deploy.

An air bag may also not deploy or work properly if the vehicle's air bag readiness light is illuminated. When illuminated, the air bag readiness light warns consumers of potential problems with a vehicle's air bag system. (If an air bag readiness light is illuminated, the vehicle should be serviced without delay.)

In used vehicles, a possible reason for the air bag not to deploy is that the air bag may not have been replaced after a previous crash. NHTSA recommends that 1) Air bags always be replaced after a deployment and 2) If, for any reason, a deployed air bag is not replaced, this information about the non-functioning air bag should be disclosed to the new owner upon the sale of the vehicle.

Any air bag that fails to deploy in an injury-producing crash should be reported to NHTSA's Office of Defects Investigation for investigation of possible system defects and potential recall. You can file a report by phone at 888-327-4236, or by mail at the following address: National Highway Traffic Safety Administration, Office of Defects Investigation, 1200 New Jersey Avenue, SE, Washington, DC, 20590.

Toyota Announces Fix for Accelerator Pedal Entrapment Problem

NATIONAL - The National Highway Traffic Safety Administration today announced that Toyota has identified a vehicle-based remedy to fix a sudden acceleration safety issue involving floor mats trapping accelerator pedals in various Toyota and Lexus models. Toyota announced the recall of these vehicles in early October and said it would soon develop a vehicle-based remedy to reduce the risk of a crash due to accelerator pedal entrapment.

The models involved in the recall are: 2007 to 2010 MY Camry, 2005 to 2010 MY Avalon, 2004 to 2009 MY Prius, 2005-2010 MY Tacoma, 2007-2010 MY Tundra, 2007-2010 MY ES 350, 2006-2010 MY IS 250, and 2006 to 2010 MY IS 350.

NHTSA said Toyota plans to reconfigure the accelerator pedal, and in some cases the shape of the floor surface under the pedal, to address the risk of pedal entrapment due to floor mat interference, particularly with regard to inappropriate or improperly attached floor mats. At the same time, Toyota will develop replacement pedals for these vehicles, which will become available for some models in April 2010. Toyota will provide owners with the new pedal, when it becomes available, even if the vehicle has already received the modified pedal under the recall.

In addition, vehicles with any genuine Toyota or Lexus accessory all-weather floor mats will be provided with newly-designed replacement driver- and front-passenger side all-weather mats.

AUTO ACCIDENT - Accident - CONCUSSION - Closed Head Injury - BLUNT TRAUMA

According to the Brain Injury Association - Concussions are a type of traumatic brain injury (TBI) caused by a blow or jolt to the head. The injury can range from mild to severe and can disrupt the way the brain normally works.

A person does not need to lose consciousness to sustain a concussion. You cannot see a concussion, but you might notice some of the symptoms right away. Other symptoms can show up days or weeks after the injury. It is best to see a health care professional if you think you might have a concussion.

An undiagnosed concussion can affect your abilities at school or work and in everyday activities.

DID YOU KNOW?

• A concussion is the most common type of brain injury sustained in sports.

• Most concussions do NOT involve loss of consciousness.

• You can sustain a concussion even if you do NOT hit your head. An indirect blow elsewhere on the body can transmit an “impulsive” force to the head and cause a concussion to the brain.

• Multiple concussions can have cumulative and long lasting life changes.

• Concussions typically do NOT appear in neuro-imaging studies such as MRI or CAT Scans.

2.1 MILLION STORK CRAFT CRIBS – Recalled – Sold by BJ’s, Sears, WalMart Stores, K-Mart, Target, J C Penney, and Costco Wholesale Warehouse

NATIONWIDE – Safety hazard! The cribs’ drop-side plastic hardware can break, deform, or parts can become missing. In addition, the drop-side can be installed upside-down, which can result in broken or disengaged plastic parts. All of these problems can cause the drop-side to detach in one or more corners. When the drop-side detaches, it creates space between the drop-side and the crib mattress. The bodies of infants and toddlers can become entrapped in the space which can lead to suffocation. Complete detachment of drop-sides can lead to falls from the crib.

The cribs, which were manufactured and distributed between January 1993 and October 2009, were sold at major retailers including BJ's Wholesale Club, Sears and Wal-Mart stores and online through Target and Costco. They sold for between $100 and $400, and were made in Canada, China and Indonesia.

CPSC urges parents and caregivers to immediately stop using the recalled cribs, wait for the free repair kit, and do not attempt to fix the cribs without the kit. They should find an alternative, safe sleeping environment for their baby.

TOYOTA / LEXUS unintended sudden acceleration risk - NHTSA says 15 fatalities

NATIONAL - According to The Detroit News (11/20, Tierney) reports, "After a highly publicized crash in August that killed four people when the driver lost control of a Lexus sedan, Toyota has come under intense pressure to reduce the risk of unintended acceleration. The Japanese automaker and U.S. safety regulators are discussing changes to the gas pedal, as well as adjustments that would make it easier to stop a car that's accelerating, according to sources familiar with the negotiations.

The U.S. National Highway Traffic Safety Administration says 15 fatalities, including the four in August, are linked to hundreds of reports of unintended acceleration of Toyotas it has received since 2002." George Peterson, president of AutoPacific Inc. in Tustin, CA, said that "the issue could be costly...if the company is found to be at fault -- and if juries are convinced Toyota knew about the problem."

Maclaren knew of stroller defect for 5 years - Could face MILLION DOLLAR FINE

According to the New York Post, "Maclaren knew for at least five years that its strollers could lop off a child's finger, but did nothing about the dangerous defect until federal regulators all but forced it to, The Post has learned."

Despite recently issuing a recall, Maclaren "failed to notify the Consumer Products Safety Commission when it first became aware of even a 'potential danger,'" and could "face a fine of $1 MILLION DOLLARS or more, sources said."

Robert Moro, an engineer and former compliance officer with the CPSC, "testified in 2007 that 'this stroller contains a substantial design defect when compared to other types of designs of strollers intended to be used by children.' The way the stroller was designed and manufactured in China violated federal guidelines intended to prevent a gruesome 'scissoring effect,' Moro said."

RECALL ♦ Maclaren ♦ CPSC ♦ Target Stores ♦ Babies R Us ♦ CHILD HAZARD for finger amputation

A million Maclaren strollers sold by Target and Babies "R" Us have been recalled, after 12 reports of children having their fingertips amputated by a hinge mechanism.
The amputation risk occurs when a child's finger is placed in the hinge mechanism of a stroller while it is being unfolded.

When the opened stroller locks into place, it can cut off the tip of the child's finger. Maclaren has offered free hinge covers in an attempt to prevent future incidents. According to the CPSC, the covers should not be removed unless the stroller is being cleaned.

The CPSC spokesperson said, “Our message to parents, grandparents and all caregivers is to make sure that you stop using these strollers until you get the repair kit, which zips the covers in place."

GOLF CART CRASH crossing road or highway from sidewalk – SERIOUS INJURIES – Liability insurance

According to the American Journal of Preventive Medicine, golf cart-related injuries are on the rise. Today, more golf carts are being used on and off the greens. If you are using your golf cart off the greens, you should consider purchasing a special golf cart insurance policy.

Golf carts are NOT covered under a person's auto policy. A homeowner's policy may provide limited liability and physical damage coverage for golf carts while used ON the insured person's property or ON THE GOLF COURSE. NOTE: Consumers likely would NOT be covered for an accident that occurs off the golf course.

Why is this important? In the event of an accident, lack of insurance coverage could mean that the operator of the golf cart would be legally liable for any and all property damage and personal injuries as a result of their negligence.

Golf carts may be inexpensive alternative way to get around in local communities, but the money saved is nothing compared to the money you may lose if the golf cart is uninsured.

Big Bend Road ♦ Lincoln Road is finally getting a traffic signal near Big Bend Road and U.S. Hwy 301

HILLSBOROUGH COUNTY - This is a dangerous intersection in Hillsborough County near Summerfield Crossings. High traffic counts from shoppers at the Publix Super Market and other well established retail stores and eight restaurants make this area for one of the worst intersections for accidents in the county.

Three years ago, when more plazas began to go up on the southwest side of Big Bend Road less than 1/4 of a mile from the existing intersection, residents began to see traffic accumulate in the medians of Big Bend, especially the one at Lincoln Road.

Statistics for the Hillsborough County Sheriff’s Office, reports are that in 2006 11 accidents occurred at Lincoln Road and Big Bend Road, 26 accidents occurred in 2007 and 21 accidents occurred in 2008. Some of the accidents involved fatalities.

According to the county’s traffic planning department, the signal light is in the design phase now, but may not be installed this year because of recent drastic budget reductions.

The Gardens ♦ Colony Cove ♦ Terra Siesta ♦ Ellenton ♦ Manatee County ♦ GOLF CART ACCIDENT ♦ US Hwy 301

MANATEE - Golf carts are illegal on state roads, with a few exceptions: The golf cart crossing at U.S. 301 and Colony Club North/Coquina Drive in Manatee County is legal.

Recently, the president of the Homeowners Association of Colony Cove said the residents have stopped driving their carts on the U.S. 301 sidewalks. Residents are hoping to change the law so they can legally drive their golf carts on the 8-foot-wide sidewalks that line both sides of U.S. 301. Residents have approached legislators, the Florida Department of Transportation, and have asked Manatee County commissioners for their support.

“Something needs to be done,” “The law should be changed.” One HOA president said, “Some of our residents are no longer able to use their cars so it’s much safer for them to be on the sidewalk in a golf cart.” Traffic light or no traffic light, crossing US 301 to go to shopping at Publix could spell disaster; especially when the highway (US 301) is widened to four lanes. I-75 • I-4 • I-10 • TRUCK ACCIDENTS • Florida State Trucking Laws •

NATIONAL - There are approximately 5,000 deaths, 100,000 injuries, and 500,000 trucking accidents every year. Trucking accidents are more likely to cause serious injury because trucks are bigger. A commercial tractor-trailer can weigh over 80,000 pounds, while an average passenger car weighs around 3,000 pounds. Thus, tractor trailer accidents often result in serious or fatal injuries for the occupants of the car.

You should know that you are NOT negotiating on level ground when dealing with a trucking company after a trucking accident. Most trucking companies are highly skilled at auto truck accident investigation and claims practice. These insurance company adjusters and investigators represent the trucking company.

Do not give them any type of statements (recorded or oral) or sign any type of release for medical records or employment records. Often the medical release allows the investigator or claims adjuster to talk to your doctors without you or anyone being present. Never accept a check from the adjuster to “cover your out of pocket expenses.”

Most trucking companies have accident investigators and adjusters that are on-call 24 hours a day and are dispatched to the scene of the crash. Many times the investigator and adjuster arrive on the scene while the police are still conducting their investigation. While the families of the accident victims are tending to emergency medical care or are making funeral arrangements, the trucking company is investigating the truck accident and setting up a legal defense.

This is just one reason why the victims of auto truck crashes should have a team of investigators and a qualified truck accident attorney fighting for their rights. The Florida Department of Public Safety has adopted Title 49, Parts 382-384 and 390-399 of the federal regulations. The Federal Motor Carrier Safety Regulations (Title 49, Parts 350-399) govern all vehicles engaged in interstate traffic.

GOLF CARTS 2 WALMART - GC2W – Sun City Center – Hillsborough County

TAMPA - In the neighborhood of Sun City Center, the golf cart is king. Every day hundreds of residents use golf carts on the streets in this south Hillsborough County community. Hillsborough County commissioners are considering building a cart path across a field from East Del Webb Boulevard to a signalized crossing at U.S. 301 and Cape Stone Avenue. The path will cost about a quarter of a million dollars according to Public Works Director Bob Gordon.

Recently, a group calling itself GolfCarts2Walmart, or GC2W, launched a petition drive that garnered 4,400 signatures. A resident has met with state Department of Transportation officials to make sure they had no objections to golf carts crossing at Cape Stone Avenue. DOT is supportive of the crossing. $8.5 MILLION DOLLAR VERDICT IN SUV ROLL-OVER

NATIONAL - A woman was awarded $8.5 million dollars in Ford SUV rollover - product liability case. The month long trial from 2005 centered around a rollover wreck of a Mercury Mountaineer (Ford) near Douglasville, Georgia. The accident killed two people and injured two others. The driver had her right leg amputated just below the knee and her left arm is paralyzed as a result of the accident. She also suffered a brain injury.

The jury heard testimony that a car had tried to get over into the SUV's lane. The SUV swerved into the left lane to avoid the car and when it attempted to go back right, the SUV flipped and rolled over four-and-a-half times.

The jury began deliberating just after 10 a.m. and returned a verdict about 2 p.m. finding that the Mercury Mountaineer built by Ford, was defectively designed and, as a result, was unreasonably prone to rollover.

Denture Creams May Cause Nerve Damage, Neuropathy - Poligrip and Fixodent

Not many Americans have heard of denture cream poisoning. A rare ailment, denture cream zinc poisoning can cause serious and debilitating nerve damage. The disorder is associated with excessive exposure to zinc in products like Poligrip and Fixodent. Denture creams like Fixodent and Poligrip contain zinc as a bonding agent. People who ingest too much zinc run the risk of copper depletion.

That condition can lead to neurological symptoms, including numbness and tingling in hands and feet, balance and coordination problems, and pain and weakness in the extremities. When it is really severe, the nerve damage caused by denture cream zinc poisoning can eventually lead to neuropathy, a debilitating disorder.

Currently, 25 denture cream poisoning lawsuits are pending in U.S. District Court, Southern District of Florida. The lawsuits allege that the zinc in products like Poligrip and Fixodent caused plaintiffs to suffer a serious copper deficiency which in turn led to neurological problems. The lawsuits also claim that the makers of these products did not provide adequate warnings about their potential dangers and that no corrective steps were taken. It is likely that more denture cream lawsuits will be filed in the coming weeks and months.
