BUS CAR CRASH • Florida student awarded $1.6 MILLION in school bus crash case • PASCO COUNTY

PASCO COUNTY – According to the Tampa Tribune, "A jury deliberated for three hours Monday before finding the Pasco County school district negligent in a 2006 crash that severely injured a 16-year-old boy. The jury awarded the student, now 19, and his parents, $1.625 million in damages, which his mother has said she will use to pay for his continuing medical care."

The student “was injured September 22, 2006, when the car he was riding in collided with a Pasco County school bus."

Two motorcyclists • Two accidents • Two deaths • TAMPA BAY

TAMPA BAY AREA - A pair of motorcyclists lost their lives this past weekend in two separate accidents. One was a single motorcycle accident where the driver lost control if his motorcycle after hitting a curb and was thrown from his motorcycle. He was transported to Bayfront Medical Center and later died.

The second motorcycle crash was apparently caused by a driver that made a left hand turn in front of the oncoming biker. The biker was also thrown from his cycle. He was transported to Brandon Regional Medical Center and later died due trauma.

Troopers say this crash is under investigation, and that charges are pending.

PINELLAS COUNTY - After two years of work, construction on Gulf Boulevard is finally nearing completion. The improvements include clearly marked bike lanes. The stretch of Gulf Boulevard that runs through Indian Shores has been a general inconvenience. But now all of the road work is finished, many say the end result is a major improvement. The three-mile long improvement project runs from Park Boulevard north to the Walsingham Bridge. The improvements include a newly paved and marked roadway, complete with dedicated bicycle and jogging paths.

PASCO COUNTY ♦ An 8-year-old New Port Richey was attacked by a 5 year-old pit bull mix dog causing serious injuries. The Pasco County Animal Services were called.

The boy was taken to a local hospital and received nearly 300 stitches from the attack.

Car Hits Elderly Woman in Church parking lot ♦ Central Florida

A parishioner was hit by a car as she walked through the parking lot at a Central Florida church. The initial investigation by police suggests that the elderly driver may have pushed the gas pedal instead of the brake.

The driver of the car was backing out of a handicap parking spot at the church when the accident occurred. After backing into the pedestrian, the driver of the car slammed into a tree causing extensive property damage.

The injured woman was airlifted to the Orlando Regional Medical Center in serious condition.

The investigation continues and charges are pending.

TAMPA ♦ An employee of Busch Gardens – Tampa Bay was injured after falling 35 feet from a gondola ride while working at the theme park.

The park did not immediately release the employee’s name or the extent of his injuries. We do know that the employee was transported to the hospital.

The employee was listed in fair condition at St. Joseph’s Hospital.

PIT BULL DOG bites 5-year-old child in the face ♦ 911 called ♦ Pinellas County Sheriff and Pinellas County Animal Services respond

MADEIRA BEACH ♦ A 5-year-old boy was attacked by a 65 pound pit bull terrier causing serious injuries. The Pinellas County Sheriff and Pinellas County Animal Services were called to the scene. The dog snapped at the child's face twice, deputies said, before the father was able to get him out of the home.

The boy was taken to All Children’s Hospital for treatment. The dog bit him on the upper lip, sheriff's officials said.

Pinellas County Animal Services took custody of the dog.

MANATEE COUNTY — According to the FHP, a motorcyclist died yesterday after running a stop sign and colliding with a vehicle in west Bradenton. The biker was on a Yamaha motorcycle traveling westbound on 18th Avenue West when he failed to stop as he entered the intersection at 51st Street in Bradenton. The biker was struck by a vehicle traveling on 51st Street. The impact caused the biker to be thrown off the motorcycle.

The motorcyclist was not wearing a helmet. He was transported to Blake Medical Center, where he was pronounced dead.

Florida Highway Patrol is completing their investigation.

PALM HARBOR -- A multi vehicle accident on US 19 at Tampa Road has caused quite a back up on this major north / south roadway this morning.

The two northbound lanes were closed by officials at the intersection of U.S. 19 near the intersection of Tampa Road. Some of the vehicles involed have overturned and BayFlight was dispacted to the scene. The victims will be transported to area hospitals. The investigation continues.

No information about the cause of the accident or the identities of those involved has been released. US 19 and Tampa Road is one of the most dangerous intersections in northern Pinellas County and is the scene of multiple accidents each year.

2 Walt Disney World buses • crash this afternoon near the Contemporary Resort on Disney property • 12 injured • FHP Investigating

OSCEOLA COUNTY - The rear-end crash happened about 2:40 p.m. when one southbound bus stopped to merge as the World Drive narrowed from three to two lanes, said Sgt. Kim Miller, an FHP spokeswoman. The second bus did not stop in time.

Fifty people were on both buses. A dozen were taken to area hospitals. Miller described their injuries as minor. Preliminary reports indicate the buses were ferrying guests from the theme parks to hotels.

Insurance companies that deny or delay legitimate claims could face civil penalties up to 1 MILLION dollars.

According to an article in The Detroit Free Press, Insurance companies that drag out or deny legitimate claims are the targets of hearings this week led by House Democrats, who said Monday that those companies should be fined up to $1 million and their executives charged with crimes.

The Democrats' 12-bill package would allow the state insurance commissioner to levy a fine of up to $1 million. It would create civil penalties up to triple the cost of the original claim and 5-year felonies for insurance company executives who encourage wrongful denial of claims.

Insurance industry spokespeople criticized the proposal as "politically motivated, unnecessary and likely to drive up insurance costs with frivolous lawsuits."

POLARIS RANGER ♦ 4x4 Roll over accident ♦ Child critically injured ♦ FHP investigating

LADY LAKE -- A young boy has died after the 4x4 he was riding on crashed over the weekend. The Florida Highway Patrol said a 12-year-old was riding the utility vehicle Sunday night when it somehow flipped over.

The boy's brother, was pinned underneath, and was taken to Arnold Palmer Hospital for Children with critical injuries. FHP said the driver and his younger sister, who was also on the utility vehicle, were not hurt in the crash.

PINELLAS COUNTY CRASH ♦ UTILITY TRUCK LOST CONTROL RUNS INTO ST. PETE BEACH STOREFRONT


PINELLAS COUNTY — A Pinellas County utilities truck crashed into a Christmas supply store Monday, slightly injuring the driver and putting the one-story building in danger of collapse, authorities said. It happened at 3:26 p.m. at Blind Pass Road and 75th Avenue, when the white truck went through the plate glass window of K. Kringles Christmas Shoppe, a holiday-themed store that sells ornaments and collectibles, officials said.

The driver of the truck, who was not identified, was treated at the scene by St. Pete Beach Fire Department paramedics, but was not seriously injured, said Fire Marshal Ernie Hand. He was cited for careless driving and released, said Sgt. Bruce Centofanti of the St. Pete Beach Police.

There were several people in the store at the time, but they escaped serious injury, officials said. Hand surveyed the building and ordered it shored up by a contractor to prevent collapse.

DUNEDIN – Over the weekend, a motorcyclist was airlifted to a local hospital after being hit near the intersection of Main Street and Lake Haven Road.

EMS was dispatched to the accident scene which was classified as a hit and run. It was unclear what type of injuries the unidentified motorcyclist sustained.

The Pinellas County Sheriff's investigation is ongoing.

HILLSBOROUGH COUNTY – West bound I-4 was closed for several hours when a semi-tractor-trailer slammed into the back of a stopped car pushing it into a FHP – Trooper’s car. The trooper was there in his car, with his lights on, to make sure motorists slowed down for road construction in the area.

The impact sent a vehicle into the patrol vehicle and the trooper's car into the vehicle in front of him. The trooper was taken to a local hospital with non-life threatening injuries.

The FHP investigation into the crash is continuing.

A GIFT to State Auto Insurance Company of $152,000.00 by Claims representative (retired)

As a thank you, a man has left $152,000 - half of his estate - to Columbus, Ohio-based State Auto Insurance Companies, where he worked for 25 years. In his will, Jack Boyle said the bequest was in gratitude for his livelihood and his good pension in retirement.

Boyle was a claims representative in Cleveland from 1953 until he retired to Boca Raton, Fla., in 1978. He was 91 when he died in Florida last year. State Auto spokesman Win Logan says the money came "out of the blue" and the company is trying to learn more about Boyle, who had no children. The rest of his estate went to family.

The insurer has turned the inheritance over to its charitable foundation and has named a program for matching corporate gifts after Boyle.

GOLF CART ACCIDENT ♦ passenger in golf cart dies after cart hit by van ♦ Florida

According to Florida Highway Patrol troopers said, a Florida man died from injuries he received when the golf cart he was riding in was struck by a van. Two men were in a golf cart when they were struck from behind by a Ford van with four occupants.

The violent impact pushed the golf cart onto the west shoulder of the road. Troopers indicated alcohol and darkness were factors in the crash. The golf cart did not have lights, troopers said.

The investigation continues.

Supermarkets and grocery stores are number two (2) for falls by industry, just behind restaurants. The Executive Director for the NFSI said, "The most likely victims are women over 60, and they typically suffer serious injuries." The principal cause of falls are stepping on slippery surfaces and stepping onto material and debris.

The NFSI reports that falls happen most frequently at the entrance to the store in water tracked in from outside the store causes many slip and falls. In addition, entry mats, poorly positioned (often moved out of position by carts) or with curled edges, cause trip and falls. The area that is the second most dangerous in the supermarket is the produce aisle. Finally, the refrigerated aisles in a supermarket or grocery store may also have leaking equipment that leads to fall risks.

According to the National Floor Safety Institute (NFSI) of Southlake, Texas, supermarkets pay out $450 million each year for legal expenses and to claimants for their injuries.

WalMart Parking Lot Accident ♦ One person with serious injuries ♦ Florida Highway Patrol investigated

LEE COUNTY – Last month a two vehicle accident in the Wal-Mart parking lot left one person with life threatening injuries. According to the witness, a man ran a stop sign striking another car with four local high school students. After the impact he lost control of his vehicle going through a ditch and then striking a semi-truck parked at the Wal-Mart loading dock.

The man who ran the stop sign was taken to the local hospital for treatment of his accident-related injuries. Florida Highway Patrol (FHP) investigated the accident. The condition of the four teenagers in the other vehicle is uncertain. All vehicles sustained moderate damage.

LITHIA • FISHHAWK TRAILS • Motorcyclist killed in afternoon crash • HCSO on the scene

HILLSBOROUGH COUNTY - According to the Hillsborough County Sheriff's Office, a motorcyclist from Lithia was killed this afternoon when he collided with a pickup truck at the intersection of Lithia Pinecrest Road and Fish Hawk Trails.

The driver of a 2007 Ford F-150 was southbound on Lithia Pinecrest Road and was turning left onto Fish Hawk Trails Road. The motorcyclist was traveling northbound on Lithia Pinecrest Road when the truck made a left turn into the path of motorcycle. The motorcyclist struck the truck on the passenger side and was ejected from his motorcycle.

The motorcyclist died at the scene. He was not wearing a helmet. The investigation continues.

SUV and PICKUP TRUCK collide on I-75 ONE CRITICALLY INJURED • FHP respond • Injured taken to TAMPA GENERAL and SOUTH BAY HOSPITALS

SUN CITY — According to the Florida Highway Patrol, two people injured resulting from a crash on Interstate 75, just south of Tampa. An out of state woman was driving a Toyota SUV north on I-75, north of Sun City Center Boulevard, in the inside lane when her right rear tire blew. The driver of the SUV lost control of her vehicle, swerved into the center lane, into the path of a Ford pickup truck.

Upon impact, both vehicles spun out of control causing the pickup truck to overturn crossing the median ending up in the southbound side of the highway. The driver of the pickup truck was transported to Tampa General Hospital with critical injuries. The driver of the SUV was transported to South Bay Hospital.

The passengers in the SUV were not injured. No charges have been filed.

OSHA and the National Transportation Safety Board (NTSB) is looking into Walt Disney World monorail crash ♦ Epcot line

LAKE BUENA VISTA ♦ A Disney employee was killed when the monorail trains collided just outside the Transportation and Ticket Center, located at the parking lot of the Magic Kingdom. A park official reported that the crash happened during a track switch attempt, while they were trying to remove one of the trains off the Epcot line.

For the first time ever, the National Transportation Safety Board is investigating Sunday's monorail crash at Walt Disney World that killed a cast member piloting one of the trains. The NSTB decided to launch a full investigation into the crash after reviewing preliminary crash information from Disney. The board said it has jurisdiction on Walt Disney World property because the monorail is a transport system used by the public. In addition, the Occupational Safety and Health Administration (OSHA) will conduct an investigation to determine if any workplace safety rules were violated.

Theme parks are not subject to state regulation. Walt Disney World and other Orlando theme parks have their own safety guidelines.
UPDATE JULY 9, 2009 - The NTSB reported that no malfunctions have been found with the automatic train stop system, nor with any mechanical parts of the switch. No mechanical problems were found with the two trains that collided Sunday. The NTSB says a pink train was changing tracks when it backed up into a purple train. "It appears that the operator of the purple train tried to reverse to avoid the collision," said an NSTB official.
UPDATEJuly 10, 2009 - Cast Members On Paid Leave After Monorail Crash - Three Disney cast members have been put on paid leave as part of the investigative process. The three positions they hold are: monorail transportation manager, monorail shop worker, and monorail pilot. Investigators still haven't found any problems with the monorails or tracks, and think human error may be to blame.

DOZEN PEOPLE INJURED IN TAMPA HARTLINE BUS CRASH with pickup truck at 56th Street and Hillsborough Avenue in Tampa

HILLSBOROUGH COUNTY -- At least a dozen people were injured in a crash involving a Hartline bus and a pick-up truck in Tampa this morning. According to Hillsborough County Fire Rescue, at least 12 people were injured when the bus and truck collided at the intersection of 56th Street and Hillsborough Avenue.
Ten passengers on the bus, the driver of the bus and the driver of the pick-up truck were all injured as a result of this intersection accident. The ten (10) passengers were taken to University Community, St. Joseph's and Tampa General hospitals. The truck driver was cited for violating the red light, troopers said. Alcohol was not involved in the crash.
Florida PIP benefits do not extend to the passengers on the bus. The driver of the pick-up truck will be eligible for PIP benefits under his motor vehicle policy. The bus driver will be eligible for workers’ compensation benefits.

Fatal crash involving a semi-tractor trailer and van closes I-75 south in Hernando County • Florida Highway Patrol on the scene • EMS • Accident

HERNANDO COUNTY - The FHP responded to the 4:50 a.m. call to find two vehicles involved in the crash, a semi-tractor trailer and a van. The driver of the semi-tractor trailer was killed in the crash. Currently the southbound lanes of Interstate 75 are blocked.

Southbound traffic is being diverted off at State Road 50. Workers are busy this morning clearing debris from the interstate. Troopers said the highway should be opened by midmorning at the latest.

The northbound lanes of Interstate 75 remain open and are unaffected.

Two injured in personal watercraft crash in near Anclote in Tarpon Springs ♦ Transported to Helen Ellis Hospital

TARPON SPRINGS — According to the Pinellas County Sheriff’s Office, two people who were vacationing in Pinellas County were injured this morning when they crashed into each other while riding personal watercraft in the Intracoastal Waterway near Anclote River Park. Both were ejected from their Sea Doo's.

The crash occurred about 10 a.m. in the Intracoastal between Anclote Island and Three Rooker Bar, according to the Pinellas County Sheriff's Office. One of them was a 15-year-old girl, who was knocked unconscious, and was transported to Helen Ellis Hospital in Tarpon Springs.

The other operator sustained only minor injuries, was cited with violating inland navigational rules after deputies determined that the 15-year-old had the right of way.

Orange County Deputy Sheriff seriously injured in Florida Turnpike Crash ♦ FHP investigates ♦ SUV ♦ Patrol car ♦ Semi-tractor trailer and car involved

ORLANDO ♦ An Orange County Sheriff's Office deputy is in serious condition after a four-vehicle crash on Florida's Turnpike.

According to a Florida Highway Patrol report, the deputy was conducting an early morning traffic stop when the driver of a SUV veered onto the shoulder of the roadway and hit the patrol car. Upon impact, the SUV then bounced back into traffic and was sideswiped by a semi tractor trailer.

The deputy and the driver of the car that was pulled over were transported to an Orlando hospital with serious injuries.

ORLANDO – On Thursday a jury awarded a $6.33 million medical malpractice verdict in favor of a Deltona woman who is now in a permanent vegetative state following a heart attack five years ago.

Lawyers said the woman had complained to her primary care physician of chest pains, fatigue, shortness of breath, dizziness and an irregular heartbeat. However, after forty three office contacts, over a two year period, her doctor never referred her to a cardiologist.

The woman who has four children has been cared for at home for the last several years by her husband, who gave up his job.

Man critically injured in I-75 crash – Rear-ended semi-tractor trailer – Transported by ambulance then helicopter to Shands Hospital in Gainesville

OCALA – According the FHP a 2002 BMW SUV slammed into the back of a semi truck on Interstate 75 late Wednesday night; the driver was airlifted to hospital in critical condition. The driver of the BMW was in the outside lane on I-75, and traffic ahead had slowed down and he failed to stop in time and rear-ended the back of the truck.

The driver of the BMW SUV had to be extricated from the vehicle. He was then was then loaded in an ambulance that transported him a short distance to an awaiting helicopter that took him to Shands Hospital at the University of Florida in Gainesville.

The accident, which occurred between the U.S. 27 and County Road 326 interchanges, backed up traffic for miles.

PORT CANAVERAL -- Thirty passengers from a Port Canaveral-based cruise ship were hurt during a shore excursion in the Virgin Islands.

According to Florida Today, passengers from Royal Caribbean's newest ship, Freedom of the Seas, were on an amphibious tour bus in St. Thomas Wednesday when the bus went off the road and crashed. The passengers had minor injures, but one had a broken ankle.

The passengers were on a seven-night Caribbean cruise and were expected to return to Port Canaveral on Sunday.

A Home Depot customer and his wife were awarded $1.5 million by a jury in a lawsuit stemming from a forklift accident at a store.

The injured customer said that a pallet of plywood fell on him from a forklift at a Home Depot store, knocking him down and causing neck and spine injuries.

The injured customer said that he was unable to resume his work in residential construction after the accident.

Allstate Floridian Insurance Company changes name to Castle Key Insurance Company

TALLAHASSEE - Allstate Floridian Insurance Company is changing its name to Castle Key Insurance Company to differentiate itself from its national parent company. The name change also applies to Allstate Floridian Indemnity Company.

A news release said, "The name changes were made in order to better reflect the fact that these property companies are separately capitalized from Allstate Insurance Company."

Allstate and other major insurers set up separate Florida companies after Hurricane Andrew caused $30 billion in damage. Allstate Floridian announced the name change Thursday. It said the new name will be the only difference customers see.

Many people this Fourth of July weekend will celebrate with cookouts, a trip to the beach, outdoor concerts and fireworks. The Fourth of July is a peak time for fireworks sales; but every year unsafe fireworks are involved in serious injuries, including loss of sight, severe burns, and loss of limbs, particularly fingers.

According to the U.S. Consumer Product Safety Commission (CPSC) estimates are that approximately 11,600 people were treated in hospital emergency rooms for injuries associated with fireworks. Three-fourths of the victims were male and about half were 10 to 19 years of age.

The Federal Hazardous Substances Act prohibits the sale of the most dangerous fireworks, including reloadable shells, "Cherry Bombs", aerial bombs, "M-80s" and "Silver Salutes." Florida law prohibits almost all devices that contain explosives. For example, firecrackers like "Black Cats" and "Ladyfingers" are illegal in Florida. Devices that are ignited and emit projectiles or launch into the air, such as "Roman Candles" and "Skyrockets" are also illegal.

Fireworks that are considered legal for the public in Florida are all hand-held or ground based devices which emit showers or sparks upon burning, but do not detonate or explode and cannot propel themselves through the air, and are approved by the State Fire Marshall's Office. Toy gun "caps", "smoke bombs", "party poppers" (which "pop" when a string is pulled), "snappers" (which "pop" when thrown on a hard surface), "snakes" (which produce a large snake-like ash when lit), and "sparklers" would be considered legal.

Sarasota County sees spike in deadly traffic crashes - US 41 - Tamiami Trail - Jacaranda - Interstate 75 - Dangereous Intersections

SARASOTA – A Sarasota County Sheriff’s team spent four hours at the intersection of Shamrock Road and Tamiami Trail pulling over drivers making mistakes. During the four hour period the team gave out a minimum of 40 tickets. The same scene played out near Jacaranda Boulevard and Interstate 75 where another sheriff's office crew zeroed in on drivers at one of the county's most dangerous intersections.

A deputy sheriff said the crackdown is part of a new plan to make traffic enforcement a bigger priority after a recent wave of deadly crashes sent the numbers through the roof. Traffic crashes involving fatalities are up 218 percent. Last year at this time we had 11 [traffic-related deaths] at this point now we are at 35. Some motorists felt the crackdown was too harsh and that deputies should have given more warnings. The sheriff’s office said, warnings don't always work when an area sees a spike in crashes, especially deadly collisions.

According to the sheriff’s office, the stepped-up enforcement isn't about making money, it's about sending a message and saving lives.

The sheriff's office plans to maintain a heavier presence on the road targeting dangerous, including drunken drivers, through the summer.

Universal Orlando • Worker injured on Dueling Dragons roller coaster • ISLANDS OF ADVENTURE

ORLANDO – According to the Orlando Sentinel, a Universal Orlando employee was injured this morning while working at the Dueling Dragons roller coaster at the resort's Islands of Adventure theme park.

The employee has been taken to the hospital, Universal spokesman Tom Schroder said, though he declined to provide further details. "It's too soon to share more information," Schroder said. "We're doing everything we can to support our team member and his family."

The accident occurred sometime after 7 a.m. before Islands of Adventure opened to the public. Schroder said Dueling Dragons has been closed "as we work to understand what happened."

Chinese experts say drywall problems likely stem from synthetic gypsum • RECOVERY OF DAMAGES MAY PROVE DIFFICULT

The Wall Street Journal (7/1, Hagerty, McQueen) reports, "The odors, respiratory complaints and corrosion blamed on drywall from China used in American homes may have been caused by the failure to remove sulfur and other contaminants from synthetic gypsum, some Chinese experts in building materials say." Yue Wenhai, vice president of the committee of gypsum and gypsum products at the Chinese Ceramic Society, a nonprofit group, says "flawed 'desulfurization' methods can leave impurities in synthetic gypsum. Duan Pengxuan, an engineer at the Beijing Building Materials Academy of Sciences Research, says he believes that the reported problems arose from inferior batches of gypsum, and that the problems aren't widespread in Chinese drywall."

RECOVERY OF DAMAGES MAY PROVE DIFFICULT. McClatchy (6/30, Greve, Chung) reported, "Chinese manufacturers made more than half of the goods that the U.S. Consumer Product Safety Commission recalled last year, but few of them paid any price for producing defective wares." The difficulty "in recovering damages is a lesson that U.S. homeowners who are stuck with defective and possibly toxic Chinese drywall are likely to learn in the coming months."

While everyone "involved is likely to be sued - installers, contractors, distributors, importers and Chinese manufacturers - the last are the hardest to reach by far."

The difficulty is such that many U.S. tort lawyers won't take cases against Chinese products unless there are American co-defendants."
